The PG&E Easement recorded on 7-27-1973, Reel 3474 Image 261, <br />discusses the right to operate overhead electrical equipment, yet PG&E apparently also <br />operates a buried gas transmission pipeline within the same area according to the National <br />Pipeline Mapping System as illustrated on the Pipeline and Hazardous Materials Safety <br />Administration (US DOT) website. The applicant shall confer with PG&E about any <br />restrictions PG&E may impose within proximity to this high-risk gas transmission main. A <br />note on the vesting tentative map indicates that the gas transmission pipeline will be <br />relocated so long as PG&E permits this relocation to locations within the subdivision’s <br />public road network or public easements. The applicant shall provide evidence from PG&E <br />that it concurs with this relocation and that the relocated facilities will thereafter be subject <br />to franchise rights conveyed via Pleasanton Ordinances 217 and 218 adopted on June 2, <br />1952, as may have been amended. If PG&E will not allow the relocation of the pipeline, <br />then the Project shall be responsible to revise the subdivision design in a manner that <br />allows the PG&E facilities to remain in their current locations. (Address this condition <br />prior to improvement plan approval) <br /> <br />55. BOULDER STREET EXTENSION. The Boulder Street extension from Valley Avenue will <br />rely on the applicant obtaining property rights (in fee) from Cubesmart across a triangular- <br />shaped parcel shown on Sheet C-200 of the VTM (also identified as APN 946-1251-8-5). <br />This parcel (or portion thereof), along with the other relevant portions of the Boulder Street <br />extension (previously offered for dedication but rejected by the City as noted in COA 56 <br />below) shall be offered for dedication to the public for roadway and utility purposes. The <br />offer of dedication shall be in a form reasonably acceptable to the City. This offer of <br />dedication shall occur prior to final map approval. Such offer of dedication shall be <br />construed as full satisfaction of this Condition 55, regardless of when the City formally <br />accepts said offer for the benefit of the public. <br /> <br />56. BOULDER STREET RIGHT-OF-WAY ACCEPTANCE. The owner of property located on <br />Parcel Map 7995 offered to dedicate right-of-way for the Boulder Street extension needed <br />to connect the Boulder Street at Valley Avenue intersection to the proposed Project. Said <br />offer of dedication was, however, rejected by the City Engineer who preserved the right to <br />accept the offer at a later date, as allowed by California Government Code §66477.2(a). <br />The acceptance can be accomplished by the legislative body [Pleasanton City Council] by <br />passing a resolution, which is then recorded at the Alameda County Recorder’s Office. At <br />such time as the applicant complies with COA 55 above (which shall happen prior to final <br />map approval), City staff will present this action to the City Council. <br /> <br />57. PARK. The park shall be owned, operated, and maintained by the HOA with a Public <br />Access Easement (“PAE”) granted to the City across the entirety of the park parcel. The <br />PAE shall grant the public rights to access the park subject to restrictions that may be <br />imposed by the HOA consistent with Pleasanton Municipal Code Chapter 13.08. The <br />Director of Community Development shall review and approve the relevant CC&R <br />provisions that address this condition prior to final map approval. <br /> <br />58. UTILITY UNDERGROUNDING. Subject to approval by the relevant utility, the joint utility <br />poles that extend along the east side of the Project site shall be undergrounded as part of <br />the Project, including the pole at the northeast corner of the Project site where existing <br />overhead cables extend north, south, and east.
