11) <br />h) All homeowners are encouraged to participate in the Livermore- <br />Pleasanton Fire Department's voluntary home fire safety inspection <br />program. <br />i) New homes located adjacent to Open Space land shall be protected <br />through the use of fire breaks, removal of any vegetation and other <br />material presenting potential fire hazards , and the use of <br />fire-retardant vegetation. <br />Mitigation Requirements for Noise. Dust. and Vibration: <br />a) All new two-story homes constructed less than 140 feet from the <br />centerline of the realigned Vineyard A venue and all new homes <br />located where projected noise levels exceed an Ldn of 55 dBA <br />(Lots 8 , 9 , 13 , 15 , 18, 19 , 20 , 21, 26, 27 , and 28) shall be <br />constructed with a fresh -air ventilation and /or air-conditioning <br />system that allows residents to maintain closed windows for noise <br />and dust control. All windows facing the RMC Lonestar plant <br />shall be dual-paned. Other mitigation measures (i.e., berms , <br />landscaping, and siting strategies) may also be necessary depending <br />upon the location of homes. <br />b) New homes located on lots where projected noise levels exceed <br />an Ldn of 60 dBA (Lots 8 , 9, 13 , 15 , 18 , 19 , 20 , 21 , 26, 27 , <br />and 28) should be designed to locate sensitive outdoor recreation <br />areas on the south side of homes (opposite the RMC Lonestar <br />quarry operations and the realigned Vineyard Avenue), wherever <br />possible. <br />c) The recorded deed of sale for all lots shall include a clause which <br />states that the property is in an area subject to excessive noise, <br />dust, and vibration levels from gravel harvesting and processing <br />and that the City of Pleasanton is not liable for possible damages <br />due to such impacts . <br />All lots within the Specific Plan Area shall also include a <br />noise/dust/ vibration easement in the recorded deed of sale. In <br />addition, a separate disclosure statement shall be provided to <br />prospective purchasers and tenants by lot owners , developers , and <br />future successors in interest. The disclosure statement shall <br />provide full disclosure of the potential future mining operations <br />within the Specific Plan Area . <br />29
