Page 4 of 6 <br /> <br />Development Projects Subject to Public Art Contribution: <br />• All new non-residential development equal to or greater than 5,000 sq. ft. <br />• All new residential development projects in excess of 20 residential units <br />• Non-residential building additions/expansions equal to or greater than 5,000 sq. ft. <br />• A project, other than a single-family home, involving expansion, remodeling, repair, or <br />reconstruction of an existing structure or structures where the value of the construction would <br />exceed $1,000,000. <br /> <br />Development Projects Not Subject to Public Art Contribution: <br />• Single family residences <br />• Residential development projects consisting of 20 units or less <br />• Tenant improvement projects <br />• Non-residential building additions less than 5,000 sq. ft. <br />• A project involving expansion, remodeling, repair or reconstruction of an existing single- <br />family home, or of a multifamily residential or commercial property where the value of <br />construction would be $1,000,000 or less. <br />• Housing projects consisting entirely of deed restricted affordable units <br />• Child Care Facilities as defined in PMC 17.38.020 <br />• Buildings and facilities used exclusively by nonprofit agencies and institutions exempt under <br />Section 501(c)(3) of the Internal Revenue Code of 1986 to provide social services to the <br />general public <br />• Buildings and facilities used exclusively for religious purposes as defined in the California <br />Revenue and Taxation Code Section 207 <br />• Condominium conversion projects. <br /> <br />Public Art Contribution: <br />• On-Site Public Art. The developer shall acquire and install a public art project on or in the <br />vicinity of the development site. The value of the public art project shall equal or exceed one <br />half percent (0.5%) of the development project’s permit valuation amount (exclusive of land). <br />As these pieces will be on private property and the owner will be responsible for ongoing <br />maintenance. Approval of art pieces will include a recommendation from the Civic Arts <br />Commission to the final approving body. <br /> <br />Monetary Contribution In-Lieu of Public Art: <br />• Non-Residential Buildings Equal to or More Than 50,000 Square Feet. In-lieu of acquiring <br />and installing a public art project, the developer of a non-residential development project of <br />more than 50,000 square feet may make a monetary contribution to the City equal to one half <br />percent (0.5%) of the development project's permit valuation (exclusive of land). Any <br />developer choosing the public art in-lieu contribution shall reserve a site and provide a public <br />art easement and an access easement for the site within the development project, if the City <br />deems such site necessary. <br />Page 9 of 116
