Page 5 of 6 <br />• Non-Residential Buildings Less Than 50,000 Square Feet. In-lieu of acquiring and installing a <br />public art project, the developer of a non-residential development project of less than 50,000 <br />square feet may make a monetary contribution to the City equal to forty-five one-hundredths <br />percent (0.45%) of the development project's permit valuation (exclusive of land). Any <br />developer choosing the public art in-lieu contribution shall reserve a site and provide a public <br />art easement and an access easement for the site within the development project, if the City <br />deems such site necessary. <br />• Residential Projects with More Than 20 Units. In-lieu of acquiring and installing a public art <br />project, the developer of a residential development project of more than 20 units may make a <br />monetary contribution to the City equal to one-half percent (0.5%) of the development <br />project's permit valuation (exclusive of land). Any developer choosing the public art in-lieu <br />contribution shall reserve a site and provide a public art easement and an access easement <br />for the site within the development project, if the City deems such site necessary. <br />*Note: The in-lieu fee shall be paid at building permit issuance, using the permit valuation number <br />as calculated or verified by the Chief Building Official to determine costs. <br /> <br />Use of Public Art Contribution In-Lieu Fee <br />Monies from the public art contribution in-lieu fee would fund the following portions of public art: <br />• Purchase <br />• Installation <br />• Maintenance <br />• Education/Programming <br />• No more than 10% for administration of the public art program <br /> <br />Having a broad range of uses for the funding, related to public art, will complement the Another <br />H.A.P.P.Y. fund. One of the largest challenges to using the Another H.A.P.P.Y. fund has been <br />identifying funding sources for installation and the long-term maintenance of new art pieces. <br /> <br />Next Steps <br />• Take Civic Arts Commission recommendations to City Council for consideration and approval <br />• Implement a public art plan, with the assistance of the Civic Arts Commission, to guide the <br />expansion and management of public art throughout the City <br />• Update PMC 13.16 to clarify the public art process and responsibilities. <br /> <br /> <br /> <br />EQUITY AND SUSTAINABILITY <br />Not applicable, as this item is an administrative matter of City business. <br /> <br />OUTREACH <br />On August 21, 2023, The Civic Arts Commission held a special meeting to approve a letter <br />requesting the City Council adopt a public art contribution program.
