Ordinance No. 2290 <br />Page 9 of 34 <br />t. Retail — Firearm sales, liquor stores, convenience markets, tobacco <br />stores, secondhand stores, and pawnshops are prohibited. <br />g. Special downtown accessory entertainment uses, as defined in Chapter <br />18.08 of the Pleasanton Municipal Code, which meet the standards found in <br />Table 18.44.080 of the Pleasanton Municipal Code. <br />h. Wineries* <br />*The following conditions shall apply prior to approval and/or operation of the <br />use: <br />(1) The zoning administrator finds adequate parking is available for <br />said use; <br />(2) Menu service shall be available for patrons during the operation <br />hours of the business; <br />(3) Alcohol service and consumption in the outdoor plaza area is <br />allowed only upon specific approval by the Department of Alcoholic <br />Beverage Control (ABC) and shall be subject to all ABC requirements. <br />The business operator and their employees are responsible for <br />supervising and controlling the activities of its customers in the outdoor <br />plaza area, ensuring no disorderly behavior occurs in this area, that <br />drinks are not taken outside of the outdoor plaza area, and there are no <br />more customers in the outdoor plaza area than there are seats. The <br />inability of the business operator and their employees to perform in this <br />manner shall be cause for review and revocation of this use as it <br />pertains to the service of alcoholic beverages in the outdoor plaza <br />area. <br />(4) Approval of a temporary/minor conditional use permit shall be <br />required prior to live music, DJ music, or dancing in the outdoor <br />plaza area. <br />(5) If the zoning administrator determines the use will be or is <br />creating odor problems, an odor abatement device determined to be <br />appropriate by the zoning administrator shall be installed within the <br />exhaust ventilation system to mitigate brewery odors; <br />(6) The applicant is in compliance with all applicable requirements of <br />Chapter 9.04 (Noise Regulations) the Pleasanton Municipal Code; <br />and <br />(7) If operation of the use results in conflicts pertaining to parking, <br />noise, odors, traffic, or other factors, the zoning administrator may <br />modify or add conditions to mitigate such impacts, or may revoke the <br />zoning certificate for the use. <br />Project Specific Condition. <br />9. OUTDOOR PLAZA: If the commercial space/s are unleased/unoccupied, the property <br />management is responsible for supervising and controlling the activities of patrons <br />within the outdoor plaza area(s). If occupied by a tenant or tenants, the tenant/s is/or <br />responsible for supervising and controlling the activities within the outdoor plaza <br />area(s). The responsible party (property management or tenant) shall ensure no <br />disorderly behavior occurs in the plaza. Project Specific Condition. <br />
