LIABILITY AND INDEMNIFICATION: To the extent permitted by law, the project <br />applicant shall hold harmless, defend (with counsel acceptable to the City), and <br />indemnify the City, its City Council, its officers, commissions, employee and agents <br />from and against any claim, action, or proceeding brought by a third party against the <br />indemnified parties and/or the applicant to attack, set aside, or void the approval of <br />the project or any permit authorized hereby for the project, including without limitation, <br />reimbursing the City its attorneys' fees and costs incurred in defense of the litigation. <br />The City may, in its sole discretion, elect to defend any such action with attorneys of <br />its choice. <br />PLANNING DIVISION — 925-931-5600 <br />Site Development, Uses, and Building Design — Residential and Commercial <br />6. DEVELOPMENT STANDARDS AND USES — NEW SINGLE-FAMILY HOMES: <br />The project site shall be developed in accordance with the approved PUD <br />Development Plan as shown on the Approved Plans referenced herein. <br />Accessory structures are not allowed, and additions and/or expansions are not <br />permitted to any of the new 14 single-family homes and lots. All other permitted and <br />conditionally permitted uses for the detached, single-family homes shall be those <br />found in Section 18.32 of the Pleasanton Municipal Code (PMC). <br />Accessory dwelling units and/or junior accessory dwelling units may be permitted in <br />accordance with state law and the Pleasanton Municipal Code. Project Specific <br />Condition. <br />7. DEVELOPMENT STANDARDS AND USES — EXISTING SINGLE-FAMILY <br />HOME (493 ST. JOHN STREET): The project site shall be developed in accordance <br />with the approved PUD Development Plan as shown on the Approved Plans <br />referenced herein. Unless otherwise specific in the conditions of approval, all <br />permitted and conditionally permitted uses shall be those found in Section 18.32 of <br />the Pleasanton Municipal Code (PMC) and any future <br />additions/expansions/modifications to the structure and/or site shall be subject to the <br />site development standards of the R-1-10,000 District of the PMC. Project Specific <br />Condition. <br />8. DEVELOPMENT STANDARDS AND USES — COMMERCIAL STRUCTURES: <br />The project site shall be developed in accordance with the approved PUD Development <br />Plan as shown on the Approved Plans referenced herein. Uses for the site shall be <br />limited to: <br />a. Bars and brew pubs* <br />b. Emergency standby electricity generator, fuel cell, and/or battery facilities, <br />photovoltaic facilities, small electricity generator facilities, and small fuel cell <br />facilities, which meet the standards in Table 18.44.080 of the Pleasanton <br />Municipal Code. <br />c. Microbreweries* <br />d. Personal services <br />e. Restaurants and catering establishments <br />
