Resolution No. 2024-077 <br /> Page 2 of 3 <br /> factors such as overall development feasibility and comparability of fees to those of neighboring <br /> jurisdictions; and <br /> WHEREAS, the EPS and Raftelis studies were prepared in accordance with all <br /> applicable provisions of state law and the Pleasanton Municipal Code, and identify the purpose <br /> of each fee, the use to which each fee wilt be put, demonstrate a reasonable relationship <br /> between each fee's use and the type of development project on which the fee will be imposed <br /> and provide how there is a reasonable relationship between the amount of each fee and the <br /> cost of the public facility or equipment or portion of the public facility or equipment attributable to <br /> the development on which each fee is imposed. The above-referenced nexus studies are <br /> incorporated herein by this reference. In addition, the studies and Capital Improvement <br /> Program identified capital projects are necessary to meet the goals, programs, and objectives <br /> within the City's General Plan; and <br /> WHEREAS, on December 3, 2024, the City Council adopted amendments to Pleasanton <br /> Municipal Code (PMC) Chapter 17.40 —Affordable Housing Fee, and Chapter 17.44— <br /> Inclusionary Zoning Ordinance, which modified the City's requirements for inclusion of <br /> affordable housing units in market-rate residential projects; and <br /> WHEREAS, there is a need, particularly in the near-term, to reduce impediments to the <br /> production of multi-family housing units and promote residential development in conformance <br /> with the Housing Element so as to meet the housing needs of all segments of the community; <br /> and <br /> NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Pleasanton, <br /> based on the entire record of proceedings, including the oral and written staff reports and all <br /> public comment and testimony: <br /> Section 1: Findings Pursuant to the California Environmental Quality Act (CEQA) <br /> The approval and adoption of the Nexus Studies and the adoption of an Updated Master Fee <br /> Schedule is not a project within the meaning of Section 15378 of the California Environmental <br /> Quality Act (CEQA) Guidelines because there is no potential for it to result in a physical change <br /> in the environment, either directly or indirectly, in that the resolution provides only for the <br /> adoption of amendments to existing fees imposed on new development. Additionally, it is also <br /> exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen <br /> with certainty that there is no possibility of a significant effect on the environment and contains <br /> no provisions that will directly or indirectly result in a physical change in the environment. <br /> Section 2: The City Council hereby approves and adopts the Nexus Studies prepared by <br /> Economic & Planning Systems, Inc., dated November 25, 2024, and by Raftelis, dated October <br /> 17, 2024, to update the City's Development Impact Fees. <br /> Section 3: The City Council hereby amends the Master Fee Schedule as set forth in the <br /> attached Exhibit C, except for projects "already in process" which shall be subject to the Capital <br /> Facilities Fee, the Transportation Development Fee and the Affordable Housing Fee in effect on <br /> December 17, 2024. The following projects are considered "already in process": 1) planning <br /> applications subject to the Permit Streamlining Act that have been deemed complete before <br /> February 15, 2025; 2) planning applications that are not subject to the Permit Streamlining Act, <br /> which have been deemed complete or have made a significant financial investment prior to <br /> February 15, 2025; and 3) building permit applications that are substantially complete and <br /> submitted to the City prior to February 15, 2025.
