<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> APPROVING AND ADOPTING THE NEXUS STUDIES PREPARED BY ECONOMIC
<br /> AND PLANNING SYSTEMS, INC., DATED NOVEMBER 25, 2024, AND BY RAFTELIS,
<br /> DATED OCTOBER 17, 2024; AND AMENDING THE MASTER FEE SCHEDULE TO
<br /> UPDATE THE EXISTING CAPITAL FACILITY, TRANSPORTATION DEVELOPMENT,
<br /> AFFORDABLE HOUSING, AND SEWER AND WATER CONNECTION FEES
<br /> WHEREAS, Chapters 3.22, 3.26 and 17.40 of the Pleasanton Municipal Code
<br /> respectively established the Capital Facilities, Transportation Development and Affordable
<br /> Housing Fees; and Chapters 14.04 and 15.05 of the Pleasanton Municipal Code respectively
<br /> establish the charges for connection to the City's water and sewer systems; and
<br /> WHEREAS, these various chapters provide that such fees and charges shall be adopted
<br /> by resolution of the City Council; and
<br /> WHEREAS, Assembly Bill No. 602, signed into law on September 28, 2021, and
<br /> effective January 1, 2022, requires that a local agency that conducts an impact fee nexus study
<br /> after January 1, 2022, must comply with new standards and practices, including, but not limited
<br /> to, calculating fees levied or imposed on a housing development project to be proportionate to
<br /> the square footage of proposed units, but with such requirement not applicable to sewer and
<br /> water connection fees; and
<br /> WHEREAS, the City has undertaken a comprehensive review of the Capital Facility,
<br /> Transportation Development, and Affordable Housing Fee, with the latter inclusive of fees for
<br /> commercial development (referred to as the Commercial Linkage Fee) and residential
<br /> development (referred to as the Affordable Housing In-Lieu Fee), to reflect the improvements
<br /> described in the 2005-2025 General Plan, the most recent 5-Year Capital Improvement
<br /> Program, and Pleasanton Development Impact Fee Long-Term Capital Improvement Program
<br /> that in part form a basis for such fees as detailed in the Fee Update and Nexus Study for the
<br /> City of Pleasanton Development Impact Fee, Commercial Linkage Fee, and Affordable Housing
<br /> In-Lieu Fee prepared by Economic and Planning Systems (EPS) dated November 25, 2024,
<br /> attached hereto as Exhibit A, and incorporated by this reference and adopts the findings
<br /> contained therein. The Development Impact Fee Study shall be made available for public
<br /> inspection within the office of the City Clerk, and on the City's website within 30 days of
<br /> adoption and
<br /> WHEREAS, the City has undertaken a comprehensive review of the charges for
<br /> connection to the water and sewer system (referred to as the water and sewer connection fees),
<br /> to reflect the improvements described in the Water Distribution System Capacity Master Plan
<br /> and incremental wastewater system improvements that in part form a basis for such fees or
<br /> charges as detailed in the City of Pleasanton Water and Wastewater Connection Fee Study
<br /> prepared by Raftelis dated October 17, 2024 that results in changes to the fees charged,
<br /> attached hereto as Exhibit B, and incorporated by this reference; and
<br /> WHEREAS, the City Council held four public workshops to consider the results of the
<br /> above-referenced studies and related amendments to the inclusionary zoning ordinance on May
<br /> 7, 2024 and August 20, 2024, October 15, and November 19, 2024, including considerations of
