Resolution No. 04-096 <br />Page 3 <br /> <br />The property involved is within the city limits of the City of Pleasanton and is the <br />beneficiary of Alameda County Quarry Permit gl, which allows the operation of a <br />quarry on site. The Owner has agreed to forgo mining of that portion of the <br />property that lies south of the realigned Vineyard Avenue. <br /> <br />Public notice has been provided as required by Government Code §51284. (All <br />references hereafter to code sections are to the Government Code). <br /> <br />Pursuant to §51283(a), the amount of the cancellation fee shall be 12 t/2 percent of <br />the cancellation value of the property on the date City Council approves tentative <br />cancellation. Based upon information provided by the Alameda County Assessor, <br />the City Council hereby determines that the full cancellation fee is $562,500. <br /> <br />10. <br /> <br />Landowner's petition for cancellation was accompanied by a proposal for a <br />specified alternative use of the land which listed those governmental agencies <br />known by the landowner to have permit authority related to the proposed <br />alternative use. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />A public hearing has been held on the petition as required by §51284. <br /> <br />The cancellation is consistent with Title 5, Part I, Chapter 7 of the California <br />Government Code. <br /> <br />The cancellation is for land on which a Notice of Nonrenewal has been served <br />pursuant to §51245, effective January 1, 1999. <br /> <br />As the right-of-way was dedicated to the City for the realigned Vineyard Avenue, <br />Agricultural Preserve Contract 1974-10B has already been cancelled for that <br />portion of the property. <br /> <br />Cancellation of this contract is consistent with the Williamson Act, in that: <br /> <br />As required by the Williamson Act the owner recorded a Notice of <br />Nonrenewal on December 16, 1998 effective January 1, 1999. <br /> <br />Cancellation is not likely to result in the removal of adjacent lands from <br />agricultural use. Uses on adjoining properties shall be developed in a <br />manner consistent with the Vineyard Avenue Corridor Specific Plan. The <br />land uses featured in the Plan include a mix of single-family homes, <br />vineyards, open space, Community Park, elementary school, and possible <br />"wine country" related uses and the PUD plan and tentative map for the <br />property are consistent with the featured land uses. The area has been <br />mzoned to PUD-MDR/OS/Vineyard (Planned Unit Development - <br />Medium Density Residential Open Space/Vineyard) District. <br /> <br /> <br />
