Resolution No. <br />Page 2 <br /> <br />04-096 <br /> <br />process the property was rezoned as PUD-MDR/OS/Vineyard (Planned Unit <br />Development- Medium Density Residential Open Space/Vineyard) District. <br />The City Council has reviewed and certified the Environmental Impact Report for <br />the Vineyard Avenue Corridor Specific Plan ("Specific Plan") which analyzed the <br />environmental effects of the anticipated development with the plan area and the <br />related loss of agricultural lands, which document is incorporated herein by this <br />reference, and that, therefore, no additional environmental review is required; <br /> <br />The City Council has approved a planned unit development (PUD) plan and a <br />Vesting Tentative Map for the property, and, in so doing, made findings that the <br />proposed development was consistent with the intent and requirements of the <br />General Plan, the Specific Plan, and that it substantially conformed to the zoning <br />regulations / development plan for the area. The Council found that the property <br />was zoned PUD-MDR/OS/Vineyard (Planned Unit Development - Medium <br />Density Residential Open Space/Vineyard) District. (a copy of the "Resolution <br />Approving Vesting Tentative Map 7385" is attached hereto as Exhibit C). <br /> <br />Thereafter, the City entered into a Development Agreement with the owner of the <br />property in connection with the development of the property subject to the Vesting <br />Tentative Map (a copy of "An Ordinance Approving a Development Agreement <br />with Lonestar California, Inc." is attached as Exhibit D). The Development <br />Agreement provides: <br /> <br />"The terms and conditions of approval of this Development Agreement have <br />undergone review by the City at duly noticed public hearings. The City has <br />determined that the Development Agreement is consistent with the City's General <br />Plan and the Specific Plan. Further, it finds that the Development Agreement <br />provides benefits to the City in that it allows timely construction of the elementary <br />school, improves the safety of Vineyard Avenue, and furthers the implementation <br />of the Specific Plan with its planned housing, agricultural open space, community <br />park, and extensive trails. The City has conducted its review of this Development <br />Agreement pursuant to the requirements of Government Code Section 65864 et <br />seq. and, on June 4, 2002, adopted Ordinance No. 1861 approving the <br />Development Agreement." <br /> <br />The Development Agreement required the dedication of a portion of the property <br />for the realignment of Vineyard Avenue and the related installation of <br />infrastructure necessary for the build out of the area. Owner has dedicated the <br />portion of the property necessary for the construction and installation of the <br />infrastructure and roadway as described in the Development Agreement.
