CITY COUNC1L OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 04-096 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br />WHEREAS, <br /> <br />WHEREAS, <br />1. <br /> <br />RESOLUTION SETTING FORTH FINDINGS AND GRANTING <br />TENTATIVE CANCELLATION OF AGRICULTURAL <br />PRESERVE CONTRACT 1974-10B- (RMC/Lonestar Property) <br /> <br />a request and petition for cancellation of Agricultural Preserve Contract 1974-10B <br />was filed with the City of Pleasanton on behalf of the owner of the property, which <br />property is more particularly described on Exhibit A attached hereto; and <br /> <br />the owner of the property recorded a Notice of Non Renewal of the Agricultural <br />Preserve Contract on December 16, 1998 effective January 1, 1999. <br /> <br />the property involved is all within the city limits of the City of Pleasanton; and <br /> <br />a public hearing was called and duly noticed for this date, as provided under <br />Government Code §51284; and <br /> <br />the City Council makes the following findings: <br /> <br />By request and petition the owner of the property has requested cancellation of <br />Agricultural Preserve Contract 1974-10B. This letter petition is incorporated <br />herein by reference as though fully set forth. <br /> <br />The subject property lies with the boundaries of the Vineyard Avenue Corridor <br />Specific Plan. The Specific Plan for the 384-acre Vineyard Avenue corridor was <br />adopted by the City Council in June 1999. The Plan is intended to facilitate the <br />transition of land uses between the urbanized edge of Pleasanton to the west and <br />the Ruby Hill development to the east. The land uses featured in the Plan include a <br />mix of single-family homes, vineyards, open space, community park, elementary <br />school, and possible "wine country" related uses. The Specific Plan identified the <br />area within which the property lies as a "residential district." The project related <br />environmental impact analysis is contained in the approved environmental impact <br />report (EIR) and, therefore~ no further environmental review is required. <br />(Attached as Exhibit B is a copy of the "Resolution Adopting CEQA Findings and <br />the Statement of Overriding Considerations for the Vineyard Avenue Corridor <br />Specific Plan and PUD Rezoning (and PUD Pre-Zoning and Minor Annexation), <br />and Approving the Vineyard Avenue Corridor Specific Plan).
