<br />3 <br /> <br /> <br />(b) In approving a project meeting the requirements of this section, a public agency shall <br />limit its examination of environmental effects to those which the agency determines, <br />in an initial study or other analysis: <br />(1) Are peculiar1 to the project or the parcel on which the project would be located, <br />(2) Were not analyzed as significant effects in a prior EIR on the zoning action, general <br />plan, or community plan, with which the project is consistent, <br />(3) Are potentially significant off-site impacts and cumulative impacts which were not <br />discussed in the prior EIR prepared for the general plan, community plan or zoning <br />action, or <br />(4) Are previously identified significant effects which, as a result of substantial new <br />information which was not known at the time the EIR was certified, are determined <br />to have a more severe adverse impact than discussed in the prior EIR. <br /> <br />Pursuant to the City’s direction, Raney proposes to prepare a Modified IS Checklist for Site Plan <br />1 only, to confirm whether the proposed project’s environmental effects meet any of the conditions <br />identified in Section 15183. If none of the conditions or exceptions are met, the proposed project’s <br />environmental effects are not subject to further CEQA review. <br /> <br />The Modified IS Checklist prepared by Raney for the above purposes will use the City of <br />Pleasanton’s “2023-2031 (6th Cycle) Housing Element Update Program EIR CEQA Guidelines <br />Section 15183 Consistency Checklist” template, which is based on CEQA Guidelines Appendix <br />G. The Modified IS Checklist will analyze the potential effects associated with the proposed <br />project. The modifications that will be made to the checklist sections will generally consist of <br />additional questions related to conditions in Section 15183. For example, a question will be added <br />to each checklist section regarding whether a particular environmental effect was analyzed as a <br />significant effect in the City of Pleasanton 2023-2031 Housing Element Update EIR. Raney will <br />work closely with City staff throughout the preparation of the Modified IS Checklist and <br />determination of appropriate findings. The Modified IS Checklist will provide a discussion of the <br />impacts related to implementation of the proposed project. <br /> <br />As previously discussed, the applicant team has provided two conceptual site plans. Site Plan 1 is <br />compliant with Land Use Element Policy 12 from the General Plan for Area 27 and Site Plan 2 <br />would require approval of a GPA to the Land Use Element Policy 12 to allow for a split open space <br />design for Area 27. As requested by the City, Raney will prepare a Modified IS Checklist for Site <br />Plan 1, which is anticipated to continue through completion of the GPA approval process, as well <br />as City approval of the Modified IS Checklist. If approval of the GPA occurs, Raney will amend <br />the approved Modified IS Checklist to include analysis of Site Plan 2. As such, Raney has included <br />Task 5 Prepare and Submit Amended Modified IS Checklist in this scope of work. <br /> <br />Consistent with PRC 21083.3, a lead agency shall require the undertaking of any feasible <br />mitigation measures specified in the prior environmental impact report relevant to a significant <br />effect which the project will have on the environment.
