<br />P24-0110; 5675 Owens Drive (4452 Rosewood parent address) Planning Commission <br />2 of 9 <br />this report. Hacienda Owners Association has indicated its support of the proposal. Further, <br />staff finds the proposed facility, as conditioned, would be consistent with the intent of the <br />General Plan and objectives of the zoning district. <br /> <br />BACKGROUND <br />California Center Property <br />California Center, an office complex with a regional conference center, is located in Hacienda <br />Business Park on Rosewood Drive, occupying an approximately 60.9-acre site. In January <br />2012, California Center property was identified as one of the sites for high-density multifamily <br /> in the 4th Cycle <br />Housing Element. As such, the southern, approximately 8.4-acre portion of the site was <br />rezoned for high-density multifamily development. The high-density residential development <br />(Case No. PUD-85-08-01D-4M) was approval by the City Council under Ordinance No. 2067 in <br />April 2013. The approval included up to 10,000 sq. ft. of retail with no minimum required to <br />serve residents. Ordinance No. 2067 lists uses that are permitted, conditionally permitted, and <br />prohibited on this 8.4-acre portion of the site. Daycare center is listed as one of the <br />conditionally permitted uses. <br /> <br />Parcel Map 10172 <br />In September 2013, California Center filed a minor subdivision application to subdivide the <br />existing 60.9 acre into three lots: <br /> <br /> Lot 59A = approximately 52.461 acres (office complex and conference center site) <br /> Lot 59B = approximately 7.394 acres (high-density residential site); and <br /> Lot 59C = approximately 1.042 acres (retail site) <br /> <br />Since the map recordation, AvalonBay Communities acquired Lots 59B and 59C. <br /> <br /> <br />With real estate market changes and based on community needs, AvalonBay Communities in <br />October 2022 requested modifications to the original approval including changing the proposed <br />use of Lot 59C from a retail use to a childcare facility. Per the PUD modification, such childcare <br />use would be permitted subject to a Conditional Use Permit, consistent with the procedures for <br />. The requested <br />modifications (Case No. PUD-85-08-ID-5M) were approved in 2022. <br /> <br />Section <br />review and approval of a conditional use permit application through a public hearing process. <br />Hence, the proposed daycare facility on Lot 59C is before the Planning Commission for review <br />and action. <br /> <br />SITE AND AREA DESCRIPTION <br />The California Center site is located at 4400-4460 Rosewood Drive, within Hacienda Business <br />Park. The site fronts on Rosewood Drive and Owens Drive. The subject site Lot 59C is located <br />on the corner of Rosewood and Owens Drives (Figure 1 outlined in blue). Adjacent properties <br />include the Park Hacienda and Hacienda Commons Apartments to the south, on the opposite <br />side of Owens Drive; Wal-Mart, a restaurant , and Metro 580 Shopping Center to the <br />west, on the opposite side of Rosewood Drive.
