WRA will <br />prepare a draft LSAA for each project for City review and comment before submitting a final <br />package upon the City’s approval. Once CDFW issues a draft agreement, WRA will review the <br />draft agreement and make recommendations to Client to accept the agreement or request <br />modifications. <br /> <br />Phase 008 – Mitigation Strategy <br /> <br />Using the City SMP mitigation requirements as a foundation, WRA will work with the City to <br />determine suitable mitigation opportunities to off-set project impacts, if needed. This task includes <br />meeting with the City to review mitigation opportunities and two site visits to conduct a preliminary <br />reconnaissance of potential mitigation opportunities within the City limits. Should the storm repair <br />projects be determined to be self-mitigating by resource agencies, then mitigation may not be <br />required. <br /> <br />Phase 009 – CEQA exemptions <br /> <br />WRA will assist the City in determining if any of the four projects qualify for a CEQA Statutory <br />Exemption, such as Section 15269 (Emergency Projects) of the CEQA Guidelines, or if each <br />project qualifies for a CEQA Categorical Exemption. If the project design and avoidance and <br />minimization measures support the application of a CEQA Categorical Exemption, WRA will <br />prepare a separate CEQA Notice of Exemption (NOE) for the CS Project and for the Bernal <br />Project which describes each project and its CEQA exemption status as well as supporting <br />information for the application of the exemption. It is anticipated each project may qualify for at <br />least one Categorical Exemption, such as CEQA Guidelines Section 15301 – Existing Facilities; <br />15302 – Replacement or Reconstruction; and 15303 – New Construction or Conversion of Small <br />Structures. Each Categorical Exemption will be supported by the Biological Resources <br />Assessment and Cultural Resources Assessment. Each NOE will also include a memo <br />attachment that explains why each project does not meet any applicable exceptions to Categorical <br />Exemptions per CEQA Guidelines Section 15300.2. Upon review and approval by the City, each <br />NOE will be filed with the County Clerk and the State Clearinghouse CEQANet portal. However, <br />if either project is found to trigger an exception to a Categorical Exemption, WRA will prepare a <br />separate proposal for a CEQA Initial Study and Mitigated Negative Declaration (IS/MND). WRA <br />will tier from existing documents to the extent feasible, including the City’s General Plan EIR, <br />project geotechnical and hydraulic analyses, and other available reports prepared for the City <br />such as the Mountain Bike Trail Environmental Impact Report. <br /> <br />Phase 010 – FEMA Environmental Planning and Historic Checklist <br /> <br />The CEQA documentation and supporting technical studies will also be used to complete two <br />separate FEMA Environmental Planning and Historic (EHP) Checklists for each of the <br />federally-funded projects pursuant to the National Environmental Policy Act (NEPA).
