Typically, the Corps may request a site <br />visit to discuss the proposed project and potential impacts on areas within their jurisdiction. <br /> <br />Section 401 Water Quality Certification/ Waste Discharge Requirements – Regional Water Quality <br />Control Board (RWQCB) <br /> <br />Based on a preliminary review of project site aerials, streams and drainages which may be <br />RWQCB-jurisdictional are present with the storm repair project sites. Should the features meet <br />the criteria for Corps-jurisdiction, then a Section 401 Water Quality Certification will be required. <br />If site features are not Corps-jurisdictional, then the RWQCB regulates fill placed in wetlands and <br />other waters via Waste Discharge Requirements (WDR). The contents of a WDR application are <br />similar to those required by a Section 401 Water Quality Certification, with some processing <br />modifications: the absence of federal permit requirements means that the permit must be taken <br />to the Water Board for approval, a process which typically requires additional attention and <br />scrutiny on the application by RWQCB staff. WRA will act as the agent for the City to the RWQCB. <br /> <br />Information required for both the 401 Certification and the WDR Application includes: <br /> <br />• Basic notification requirements as to site location; project description; and type and amount <br />of fill in potentially jurisdictional areas; <br />• Appropriate plan and cross-sectional view figures that show proposed impacts to jurisdictional <br />areas; <br />• Delineation map based on a site visit conducted by WRA staff; <br />• A watershed profile describing the current status and trends of aquatic resources within the <br />watershed; <br />• Proposed compensatory mitigation for any loss of jurisdictional areas; <br />• Alternatives analysis documenting rationale for why impacts to the wetland cannot be avoided; <br />• Anticipated schedule for project construction; <br />• Information regarding post-construction stormwater management based on the project’s <br />stormwater management plan; and <br />• Certified Environmental Quality Act documentation (Mitigated Negative Declaration/EIR/ <br />Categorical Exclusion). <br /> <br />CDFW Streambed Alteration Agreement <br /> <br />CDFW requires any person who may affect the bed or bank of a perennial, intermittent, or <br />ephemeral river, stream, or lake to provide notification via a California Fish and Game Code <br />Section 1602 Lake and Streambed Alteration Agreement (LSAA). The LSAA notification requires <br />completion of an application form and project environmental questionnaire, and inclusion of <br />supplemental data regarding issues covered in the project environmental questionnaire.
