<br />City of Pleasanton P6621.002.000 <br />Storm Damaged Repair Sites March 7, 2024 <br />PROPOSAL FOR ENGINEERING DESIGN SERVICES Latest Revision March 25, 2024 <br /> Page 4 <br /> <br />the applicant to provide a description of the Project (specifically any actions that may have an <br />effect on federally-listed species), a description of the specific areas that may be affected, the <br />manner in which impacts may occur, an analysis of cumulative impacts, and a description of the <br />listed species or critical habitats that may be affected. This document is called a Section 7 <br />Biological Assessment (BA). <br /> <br />WRA will utilize available data from the BRTR to the maximum extent possible, and may need to <br />generate additional field survey data to compile all data necessary to prepare BA reports for <br />submittal to the Corps. The BAs will describe the suitability of on-site habitat conditions for the <br />federal-listed species known to occur in the vicinity. The reports will discuss any potential impacts <br />(including direct, indirect, and cumulative impacts) that may occur to these species as a result of <br />the Project, and any mitigation measures recommended to offset potential impacts. WRA will <br />produce a round of draft BAs for City review prior to submittal. <br /> <br />Phase 007 – Resource Agency Permits <br /> <br />As noted above, the storm repair locations are grouped into two ‘Projects.’ The CS Project and <br />the Bernal Project will have a separate suite of regulatory agency permit applications, described <br />below. The permit applications described below will be prepared for each of the four storm repair <br />project sites. <br /> <br />Section 404 Permit -Army Corps of Engineers (Corps) <br /> <br />In the interest of planning, WRA will operate under the assumption that features within each <br />project site are subject to the jurisdiction of the Army Corps of Engineers (Corps). Once the <br />wetland delineation has been completed, this assumption will be revisited, and the permitting <br />strategy adjusted as needed. Given the size of the storm repair project sites and the nature of the <br />repairs, project activities may qualify for coverage under Nationwide Permit (NWP) 3 – <br />Maintenance or NWP 18 – Minor Discharges. An Individual Permit is not anticipated for any of <br />the projects at this time. WRA will prepare permit application packages for submission to the <br />Corps based on information available from the site plan. The permit application packages will <br />address potential impacts to Corps and RWQCB jurisdiction and the necessary permit <br />requirements, including: <br /> <br />• Basic notification requirements as to site location; project description; and type and amount <br />of fill in potentially jurisdictional areas; <br />• Appropriate plan and cross-sectional view figures that show proposed impacts to jurisdictional <br />areas; <br />• Information to support a determination that the project will not affect cultural resources, based <br />on the cultural resources report prepared for project approval under the California <br />Environmental Quality Act (CEQA); <br />• Information to support an informal consultation with the U.S. Fish and Wildlife Service, or if <br />supported by substantial evidence, determination that the project will have no effect on <br />endangered species; <br />• Section 404 delineation map based on a site visit conducted by WRA staff; <br />• Proposed compensatory mitigation for any loss of jurisdictional areas; <br />DocuSign Envelope ID: 9D598DAC-5F24-41FA-B827-97D013A47ECADocuSign Envelope ID: CEB20404-63F8-4DC5-AE6A-C5FC89DB6F87
