Resolution No. 2024-021 <br /> Page 5 of 7 <br /> retirement, including the recordation and reporting of all hours worked for the <br /> City to CalPERS as required. The parties acknowledge that Chief Anderson is <br /> limiting to working 960 hours in the fiscal year by §21221(h). <br /> b. Indemnity for CalPERS Claimed Overpayments. The City agrees to defend and <br /> indemnify Chief Anderson for any fees, fines, penalties, contributions or other <br /> monetary damages claimed, asserted, or alleged against Chief Anderson by <br /> CalPERS as a result of her employment with the City upon a finding that the <br /> City failed to keep or report Chief Anderson's accurate hours worked. <br /> c. Representations required by CalPERS. Chief Anderson represents that she is a <br /> retired annuitant of CalPERS within the meaning of§21221(h), represents that she <br /> has not received unemployment compensation from any CalPERS agencies during <br /> the twelve (12)-month period preceding the effective date of this Agreement, <br /> represents that she has not received a retirement incentive from her prior employer <br /> from which she retired, and acknowledges that her compensation is statutorily <br /> limited as provided in California Government Code Section 21221(h). <br /> d. No Benefits. Pursuant to §21221(h) and related CalPERS regulations and <br /> policy statements, Chief Anderson shall not receive from the City any benefits <br /> that the City commonly provides to its employees, including without limitation <br /> health,dental, or vision insurance coverage, life insurance,employee assistance <br /> programs, and similar benefits. <br /> e. No Leave. Chief Anderson, in accordance with §21221(h) and related <br /> CalPERS regulations and policy statements, shall not be provided or accrue any <br /> personal time off, vacation, sick leave, administrative lease, paid holidays or <br /> similar leave benefits. <br /> 8. Termination. <br /> a. By City. This Agreement may be terminated by the City for any reason thirty <br /> (30)days after providing written notice to Chief Anderson of such termination. <br /> The City's only obligation in the event of such termination will be payment <br /> to Chief Anderson of all compensation then due and owing up to and <br /> including the effective date of termination. <br /> b. By Chief Anderson. This Agreement may be terminated by Chief Anderson for <br /> any reason thirty (30) days after providing written notice to the City of such <br /> termination. The City shall have the option, in its complete discretion, to make <br /> Chief Anderson's termination effective at any time prior to the end of such <br /> period, provided the City pays Chief Anderson all compensation then due and <br /> owing her through the last day actually worked. <br /> c. By Regulatory Requirements. This Agreement may be terminated immediately if <br /> necessitated by changes to CalPERS statutory or regulatory requirements. <br /> d. No Notice for Expiration.Nothing in this Section 8 Termination shall be construed <br />
