Valley Avenue/KollCenter Parkway (North) -- The developer shall design and <br />install a signal at this intersection and make other roadway improvements to <br />accommodate the signal as deemed necessary by the City's Traffic Engineer. The City <br />will make a best effort to engage the participation of other area developers to commit <br />funds to this signal on a pro-rata share basis to the extent feasible. The developer may <br />enter into a reimbursement agreement with the City to receive any remittance from other <br />developing properties, or from a City local traffic fee if one is adopted, towards the cost <br />of the installation of the signal once the project is under construction. <br /> <br />5. Prior to issuance of building permits for the first building, the developer shall submit to <br />the Engineering Division for review and approval plans for the relocation of the sanitary <br />sewer line and storm drain line traversing the property. Both existing lines shall be <br />plugged and may be abandoned "in place" outside of the building structures if backfilled <br />per City standards. The developer shall prepare all documents for the City to abandon the <br />existing easement and provide a new sanitary and storm drain easement. Said documents <br />shall be approved as to form by the City Attorney. <br /> <br />6. Prior to the issuance of building permits for the first building to be constructed, the <br />applicant shall resolve the parking shortage through one of two means, as follows: <br /> <br />a. The site plan shall be revised, subject to the review and approval of the Planning <br />Director, to show an additional 17 parking spaces. No required landscape areas, building <br />setbacks, etc. shall be compromised in order to provide for the additional spaces; or <br /> <br />b. The developer shall apply and receive approval for a PUD modification to the <br />entire Bernal Corporate Park reducing the required parking ratio from its current 1 <br />space/250 square feet of net floor area (95% of gross) to I space/300 square feet of gross <br />floor area. <br /> <br />7. Prior to the issuance of building permits, the construction drawings shall indicate the <br />location of all trash enclosures, service areas, loading areas, etc. All trash enclosures and <br />loading areas shall be designed in a manner compatible with the building design, <br />materials, and colors and shall be screened from view as indicated in the BCP design <br />guidelines. Trash containers shall be stored within the enclosures at all times, except <br />when being unloaded. <br /> <br />Landscaping and Tree Preservation <br /> <br />8. A final landscape plan and irrigation plan shall be submitted to and approved by Planning <br />Director as part of the building permit plan set prior to issuance of an on-site permit. <br />Said landscape plan shall be consistent with the approved landscape plan plus any <br />conditions of approval, and shall be detailed in terms of species, location, size, quantities, <br />and spacing.
