If the City Council declares a drought during a time when this <br />development is under construction, as described in §9.30.010 et seq. of the Pleasanton Municipal <br />Code, the applicant shall utilize only recycled water under Stage 1 or greater restrictions for all non- <br />potable construction-related water needs. Recycled water is available at designated locations <br />within the City, subject to the applicant’s receipt of a temporary hydrant meter from the Operations <br />Service Center located at 3333 Busch Road. The applicant is responsible for all water costs based <br />on current billing rates. (Address this condition during construction) <br />82.EXISTING FRONTING SIDEWALK IMPROVEMENTS. The applicant shall examine the public <br />sidewalks that front the property along both Santa Rita Road and Lockhart Lane for conditions that <br />could endanger persons or property or are found to be in a condition that interferes with public <br />convenience. These conditions shall be repaired as part of the development according to adopted <br />City standards pursuant to California Streets and Highways Code 5610 et seq. This will include not <br />only concrete repairs, but also faded, peeling red curb paint. (Address this condition during <br />construction) <br />83.HIGH RISK FACILITY. The National Pipeline Mapping System operated by the U.S. Department of <br />Transportation’s Pipeline and Hazardous Materials Safety Administration indicates that a high- <br />pressure gas transmission main exists in Santa Rita Road across the applicant’s property frontage. <br />This pipeline must be shown and identified as a “high-risk facility” on plans for the development. <br />Any excavation work within the vicinity of the high-risk facility shall be subject to specific regulations <br />promulgated by the utility operator. (Address this condition prior to issuance of any Building Permits) <br />84. EXCAVATION SAFETY. All excavations must be performed in conformance with California <br />Government Code Section 4216 et seq. No excavation shall occur until proper notice is provided <br />to Underground Service Alert (usanorth811.org) by calling either 811 or 800-642-2444 at least 72- <br />hours prior to the work so buried utilities can be marked. All excavations shall be covered or <br />barricaded to prevent entry when work is inactive. Open excavations in the public right-of-way <br />must be covered by skid-resistant steel plates that are firmly affixed to the surface with leading <br />edges ramped. Excavations 5-feet and deeper require a protective system as defined by Cal- <br />OSHA. If a shoring system or trench boxes will be utilized as the protective system, said system <br />shall either be manufactured and installed according to manufacturer recommendations, or <br />designed by a registered professional engineer and installed according to approved plans. <br />(Address this condition during construction) <br />85.PROPERTY NUISANCE. At no time during construction of the project shall the condition of the <br />property become a nuisance as defined in Pleasanton Municipal Code §9.28.020. The City shall <br />have the right to inspect the property for conditions that violate the code standard. If a nuisance <br />is found, the applicant shall immediately submit a plan of correction. Depending on the severity <br />of the nuisance, the City may suspend all construction work until the condition is corrected. Any <br />of the following conditions shall be considered severe: Leaking chemicals that can cause <br />environmental damage; open excavations or any excavation deeper than 4 feet that lacks proper
