The City En- <br /> gineer will refer said map <br /> or sketch to all public util- <br /> ities for review. <br />5.04 CERTIFICATION OF MAP <br /> AND CONVEYANCE~ If <br /> the Subdivision Committee <br /> determines that the pro- <br /> posed subdivision meets the <br /> requirements of the Ordi- <br /> nance, then they shall certi- <br /> fy to this fact on the face <br /> of the map, and any convey- <br /> ance ,to be drawn by the <br /> owners of the land subdi- <br /> vided. <br />5.0~ REQUIREMENTS W H I CH <br /> MAY BE IMPOSED. 'Pbe <br /> following requirements may <br /> be imposed as a condition of <br /> approval of minor subdivi- <br /> sions: <br /> 1. Dedication of u t i I i t y <br /> <br /> 2. Proof that there are ade- <br /> quate utilities for the pro- <br /> posed use of the land, such <br /> as an adequate water sup~ <br /> ply, adequate sanitary sew- <br /> er facilities, and adequate <br /> drainage facilities. <br />5.06 EXEMPTION FROM RE- <br /> Q~NT OF FILING <br /> FINAL MAP. Minor sub- <br /> divisions as defined herein <br /> are exempt from the pro- <br /> visions of Article 6 of this <br /> Ordinance requiring t h e <br /> preparation and filing of a <br /> final map. <br />5.07 APPEAL TO COMMISSION. <br /> In the event the subdivider <br /> is dissatisfied with any de- <br /> termination of the Subdivi- <br /> sion Committee or its des- <br /> ignoe, either as to the de- <br /> termination as to whether a <br /> proposed subdivision quali- <br /> <br /> any requirements or condi- <br /> tions which the Subdivision <br /> Committee seeks to impose, <br /> then the subdivider may ap- <br /> peal to the Commission by <br /> filing a statement in writing <br /> with the City Cleark within <br /> three days prior to final ac- <br /> tion by the Planning Com- <br /> mission under Section 5.08, <br /> stating his .reasons for <br /> appeal. <br />5.08 D~r~RMINATION B Y <br /> COMMISSION The Commis- <br /> sion must approve, affirm, <br /> reverse or modify any de- <br /> termination of the Subdivi- <br /> sion Committee or its des- <br /> <br /> ignee with respect to the <br /> proposed minor subdivision, <br /> within 30 days after Sub- <br /> division Committee action <br /> under Section 5.04. <br /> <br /> ARTICLE 6 <br /> THE FINAL MAP <br />6.01 FILING. Within one (1) year <br /> after a~0proval or conditional <br /> approval of the tenative map, <br /> the subdivider may cause <br /> part or all of the subdivi- <br /> sion to be surveyed and a <br /> final map prepared by a <br /> - registered civil engineer <br /> or licensed surveyor, con- <br /> forming to the approved <br /> tentative map. Four <br /> (4) blue line or black line <br /> prints of the final map and <br /> such other copies as may be <br /> required for checking and <br /> approval shall be submitted <br /> to the City Clerk together <br /> with a checking fee of <br /> twenty-five dnllars ($25.00) <br /> ,91us one dollar and fifty <br /> cents ($1.50) per lot shown <br /> on the final map. <br />6.02 TI~E EXTENSION. <br /> Upon written application of <br /> the subdivider made within <br /> one (.1) year of the approval <br /> or conditional approval of <br /> Ohe tentative map, the .Coun- <br /> cil may grant an extension <br /> of time not exccedin~ one <br /> one (1) year for filing of <br /> the final map. The applica- <br /> tion should be filed at least <br /> fourteen (14) days in ad- <br /> vance of the expiration of <br /> the tentative map to permit <br /> a report and recommenda- <br /> lion of the proposed exten- <br /> sion of time to be made by <br /> the Commission. Said appli- <br /> cation must include the rea- <br /> <br /> request. <br />6.03 DOCUMENTS TO BE FILED <br /> WITH MAP. At the time of <br /> submitting the final map, the <br /> subdivider shall submit the <br /> following: <br /> a) TRAVERSE: SHEETS. <br /> Traverse sheets in a form <br /> approved by the ,City Engin- <br /> eer giving latitudes and de- <br /> partures and coordinates of <br /> the boundary of the su~bdiv- <br /> ision and blocks and lots. <br /> b) IMPROVEMENT PLANS. <br /> Copies as may be required <br /> of detailed plans, cross zee- <br /> tions, profitos and specifi- <br /> cations of the improvements <br /> to be installed, and of all <br /> other improvements pro- <br /> posed to be installed by the <br /> <br />subdivide~,~ ~'~-~a~ ~b~'~ '~- <br />tract, and the estimated <br />cost thereof. Plans shall be <br />prepared by a registered <br />civil engineer as .required by <br />the City Engineer. Sheets <br />shall be 24" x 36" with a <br />2" left margin and a plan <br />and profile drawn to a scale <br />of 1" equals 40', or 1" equals <br />50'. l)etalls shall be shown at <br />appropriate scale. Plans and <br />profiles of all streets shall <br />normally be required, and <br />in addition an overall grad- <br />lng plan of the proposed sub- <br />division may be required. <br />Any requirement for submit- <br />ting a gradi~,g plan with the <br />final map shall be made by <br />the Planning Commission at <br />the time of approval of the <br />tentative map. <br /> <br /> c) DESIGN DATA. Design <br /> data, assumptions and comp. <br /> utations shall be submitted <br /> <br />drainage and street pave- <br />ment design. Analyses shall <br />be extended outside of the <br />subdivision boundary when <br />necessary. All analyses shall <br />be prepared in accordance <br />with s o u n d engineering <br />practices, shall be accurate <br />and in a form easily interp- <br />reted, and shah be accom- <br />panied by certified test <br />reports when required by the <br />City Engineer. <br /> <br />d) REPORT AND GUARAN. <br />TEE OF CLEAR TIT~E. The <br />final map shall be accompan- <br />ied by a report prepared by <br />a duly authorized title com- <br />pany naming the persons <br />(o~her than persons owning <br />interests of the character de- <br />scribed in Subsections la and <br />lb of Section 6.15) whose <br />consent is necessary to the <br />preparation and recordation <br />of said map and to the dedi- <br />cation of the streets, alleys <br />and other ,public places, and <br />certifying tha~t as of the date <br />of the preparation of the re- <br />port, the persons therein <br />named are all the persons <br />necessary to give clear title <br />to said subdivision. At the <br />time of recording, there shall <br />be filed with the County Re- <br />corder a guarantee (execut- <br />ed by a duly authorized title <br />company for the benefit and <br />protection of the City) show- <br />ing that the persons named <br />and consenting tn the prep- <br />aration and recordation of <br /> <br /> RE::1,456, 1 :958 <br /> said map and offering for <br /> dedication the streets, alleys <br /> and other public places <br /> shown thereon are ali the <br /> persons (other than persons <br /> owuing interests of the char- <br /> acter described in Sub-sec- <br /> tions la and lb of Section <br /> SAS) necessary to pass clear <br /> title to said subdivision and <br /> to the dedication shown <br /> thereon. <br /> e) INSPECTION COSTS. Be- <br /> fore approval ia given ,the <br /> final map the subdivider <br /> shall deposit with the City <br /> Clerk in cash or certified <br /> check the costs of inspec- <br /> lions to be made by the ,City <br /> according to the following <br /> scale: <br /> 4% of the estimated cost of <br /> improvements t~p to and in- <br /> cluding $25,000.00. <br /> 3¥2% of the estimated cost <br /> of improvements from $25,- <br /> 001.00 up to and including <br /> $75,000.00. <br /> 3% of the estimated cost of <br /> improvements on any <br /> amount in excess of $75,- <br /> <br /> N'o refunds will be made, <br /> and no additional charges <br /> will be made. <br /> f) AGREEMENT AND <br /> BOND. The agreement and <br /> bonds specified in Sections <br /> 8.05 and 6.09 of this Ordin, <br /> <br /> g) DEED RESTRICTIONS. <br /> Three (3) coptes of all pro- <br /> posed deed restrictions. <br />0.04 APPROVAL BY CITY EN- <br /> G1NEER. Upon receipt by <br /> the City Clerk of the final <br /> map and other data submi$- <br /> ted, said map and data shall <br /> be referred to the City En- <br /> gineer who shall examine <br /> them to determine that the <br /> subdivision as shown is sub- <br /> stantiuily the same as it ap- <br /> peared on the approved ten- <br /> tative ma~o, and any approv- <br /> ed alterations thereof; that <br /> all provisions of the law and <br /> of this ordinance applicable <br /> at the time of approval of <br /> the tentative map have been <br /> complied with; and that he <br /> is satisfied that the map is <br /> technically correct. If the <br /> City Engineer determines <br /> that the map does not fully <br /> conf~rm, he shell advise the <br /> subdivider of the necessary <br /> changes or additions and al- <br /> low an opportunity ~or the <br /> subdivider to make s u c h <br /> changes or additions.
