Prior to ~he approv- <br /> al by the Council of the final <br /> map, 'the subdivider shall ex- <br /> ecute and file an a~reement <br /> between himself and the <br /> City, specifying the period <br /> within which he shall com- <br /> plete all improvement work <br /> to the satisfaction of the City <br /> Engineer, and providin~ that <br /> if he shall fail to ~omptete <br /> such work within such per- <br /> iod, the City may complete <br /> the same and recover the <br /> full cost and e~pense there- <br /> of from the subdivider. The <br /> agreement aizo shall provide <br /> for inspection of all improve- <br /> ments by the City Engineer. <br /> Suoh agreement may also <br /> provide: <br /> 1. 'For the construction of <br /> the improvements in units, <br /> g. For extension o! time un- <br /> der conditions therein specx- <br /> fled. <br /> g. /For progress payments to <br /> the subdivider or his order <br /> from any deposit money <br /> which the subdivider may <br /> have made in lieu of provid- <br /> ing a surety bond, providing <br /> however, bhat no such pre- <br /> gress payment shall be made <br /> [or mare than ninety (90%) <br /> per cent of the value of the <br /> work completed to the mai- <br /> is/action of the City Engin. <br /> eer. <br /> 4. For the financing and con- <br /> struction of any or all of <br /> such xmprovements under <br /> appropriate special assess- <br /> ment act proceedings, in <br /> which casa the s~vider <br /> shall agree, in wr/tin~, to <br /> initiate, and so !er as may <br /> be in his power to consumate <br /> such proceedings, w i t h i n <br /> such thne as may be pre- <br /> scribed by the Council. <br /> 6.06 APPROVAL BY CITY <br /> COUNCIL. At its next reg- <br /> ular meeting, or within a <br /> period o! not more than ten <br /> days following the City En- <br /> gineer's transmittal of bhe <br /> final map to the City Clerk, <br /> the Council shall consider <br /> said map, the improvement <br /> plans of the subdivision, and <br /> the offers c~f dediestion. In such case..vzhen the <br /> agreement and bond or de- <br /> posit have been approved by <br /> the City Attorney as to form, <br /> and by the City Engineer <br /> as to sufficiency, the Coun- <br /> cil may consider the final <br /> <br /> The Council shall approve <br /> said map if ii conforms to <br /> the requirements of this or- <br /> dinance and ~ubdivision fMap <br /> Act. If it d~es not conform <br /> it shall be disapproved and <br /> the subdivider so informed. <br />6,0T ACTION BY THE CITY <br /> CLERK. The City Clerk up- <br /> on al~provsi by the Council <br /> of the final map, the receipt <br /> <br /> es and seals have been affix- <br /> ed to the map, shall cause <br /> ~he map to bo transmitted to <br /> the County Clerk. who shall <br /> <br /> N~) map shall have any force <br /> or effect until the same has <br /> been approved by the Coun- <br /> cil, and no title to any prop- <br /> erty described in any offer <br /> of dedication shall pass until <br /> recordation of/:he final map. <br /> <br />6.08 S U B M I S SION OF ADDI- <br /> TIONAL COPIES. Immediat- <br /> ely subsequent to the rec- <br /> ordation of the final map, <br /> thc subdivider thereof shall <br /> <br /> cop/es of the final m;~p and <br /> affidavit sheet as follows: <br /> a) One (1) dupilcete tracing <br /> on cloth wi~h all recording <br /> data thereon to be filed with <br /> the City Engineer. <br /> b) Three (3) reproductions, <br /> one on cloth, to be filed with <br /> the City Clerk, <br />6.09 BONDS. Ti~e subdivider <br /> shall also file wif~h the agree- <br /> ment a faithful ~erformance <br /> bond in an amount deemed <br /> : sufficient by the City Engin- <br /> <br /> ' improvements, and incident <br /> ial expenses, and a "labor <br /> and materials" bond in an <br /> amount required by law on <br /> bonds for public construc- <br /> 'tion, and by its terms to in- <br /> <br /> ial-men upon work and im- <br /> provements conditinned upon <br /> the payment of labor and <br /> materials for labor and mat- <br /> erials rendered and perform- <br /> ed under the terms of the <br /> agreement. Such bends shall <br /> be executed by a surety corn? <br /> pany authorized to transact <br /> a surety business in the State <br /> of California and must be <br /> satisfactory to and be ap- <br /> proved by the City Altorney <br /> os to form. In lieu uf the <br /> failhful performance bond <br /> and the "labor and mater- <br /> ials'' bond, the subdivider <br /> may doposit cash with the <br /> City Clerk in the amount of <br /> t h e faithful performance <br /> bond. <br />6.10 FOI~EITUILE OF SURETY.- <br /> In the evens the subdivider <br /> shall fail to complete all im- <br /> provement work in accord- <br /> ance with the ,provisions of <br /> this chapter and the .City <br /> shall cause same to be eom- <br /> pleted, then the City .may <br /> call on the surety company <br /> for, or may appropriate from <br /> any cash de.)sits, fuads for <br /> rehnbu~semeut. If the, am- <br /> ount o/ the surety bond or <br /> cash deposit shall be less <br /> than the cost and exponse <br /> incurred by the City, the <br /> subdivider shall be linble to <br /> the City for such differences. <br />6.11 RELEASE OF SURETY. No <br /> extension ot time, progress <br /> payments from cash deposits, <br /> or a release of a surety or <br /> cash deposit shall be made <br /> except upon certification by <br /> the .City Engineer bhat work <br /> covered thereby has been <br /> satisfactorily compteted, and <br /> upon approval of said im- <br /> provements by the Council. <br />6.12 PR~FARATION OF FINAL <br /> MAP: SIZE, MA'f/~ttlALS, <br /> SCALE. The final map shall <br /> be clearly and legibly drawn <br /> in black waterproof India <br /> ink upon good tracing cloth, <br /> but affidavits, certificates <br /> and acknowledgements may <br /> be legibly stamped or print- <br /> ed upon the map with opaque <br /> ink. Signatures shall be in <br /> opaque black ink. 'l~he dim- <br /> ensions of each sheet of said <br /> map shall be 18 inches by <br /> 26 inches. A marginal line <br /> shall be drawn completely <br /> around each sheet, leaving <br /> an entirely blank mar~in of <br /> I inch. The minimum scale <br /> of the map shall be i inch <br /> <br /> I [:1.456,lM :959 <br /> equals 60 feet 'unless l~rior <br /> written approval is obtained <br /> from the .City Engineer. All <br /> details shall show clearly, <br /> and enough sheets shall be <br /> used to accomplish this end. <br /> The particular number of <br /> the sheet and the total num- <br /> be of sheets comprising the <br /> map shall be stated on each <br /> of the sheets and the relative <br /> location of each ac~oining <br /> sheet shall be clearly shown <br /> by a small key map on each <br /> sheet. Each sheet shall show <br /> the date of the survey, north <br /> point, and .written and gra- <br /> phic scale. The map shall be <br /> so made and shall be in such <br /> condition vzhen filed that <br /> good legible prints and neg- <br /> atives can be made there- <br /> from. <br /> <br />6.,13 SA~E: TITLE. The title of <br /> each sheet of said final map <br /> shall consists ot the approv- <br /> ed name and unit number of <br /> the tract, consp/cuonsIy ptsc- <br /> ed on the sheet followed by <br /> the words "City ol Pleasan- <br /> t~n!!, and followed by the <br /> tract numbor. Mops filed for <br /> the purpose of sho~,ving as <br /> acreage land previously sub- <br /> divided into parcols or lets <br /> or bleeks shall be conspic- <br /> uously designated with an ap- <br /> propriate approved title. <br /> <br />6.14 SA, ME: COORDINATE SYS- <br /> TEM. Wherever the City En- <br /> gineer has established a sys- <br /> tem of coordinates then the <br /> survey shall be tied into such <br /> system. The adjoining corn- <br /> ers of all adjoining subdiv- <br /> isions shall be indentified by <br /> tot and block numbers, sub- <br /> division name and place of <br /> record, or other proper des- <br /> ignation. The mapl~ng angle <br /> shall be indicated on the <br /> map, and the point at which <br /> this mapping angle is correct <br /> shall be indicated as well as <br /> the coordinates of that point. <br /> <br /> 6.15 CERTIFICATES, ACKNOW- <br /> LEDGEiWENTS AND DES- <br /> CRIPTION. The title sheet <br /> of the map; below the title, <br /> shall show the name of the <br /> engineer or surveyor, tngetb- <br /> er with the date of the sur- <br /> vey, the scale of the map <br /> and the number of sheets. <br /> The following certificates, <br /> acknowledgements and des- <br /> cription shall appear on the <br /> title sheet of the final maps. <br /> Such certificates may be <br /> <br /> <br />
