<br /> 2.04 "GENERAL PLAN" shall
<br /> mean the General Plan of
<br /> the City of Plessanton, adop-
<br /> ted by Ordinance No. 309,
<br /> effective July 1, 1960, and
<br /> any amendment thereto, or
<br /> any General Plan adopted
<br /> subsequent to the adoption
<br /> of ,this ordinance and super-
<br /> seding said plan adopted
<br /> July 1, 1960.
<br /> 2.05 "LOT" shall mean a parcel
<br /> or portion of land separated
<br /> from other parcels or per-
<br /> tions by description as on a 2.14
<br /> subdivision or record of sur-
<br /> vey map or metes and
<br /> bounds for purposes of sale,
<br /> lease or separate use.
<br />2.06 "MAJO~R THOROUGH-
<br /> FARE", "SECONDARY
<br /> THOROUGHFARE",
<br /> "F~EEWAY" and "P.M',~-
<br /> WAY" shall mean a vehie.
<br /> ular route ap designated on
<br /> .the General Plan or any
<br /> other vehicular ,route so des-
<br /> ignated by the City Council,
<br /> on recommendation of the
<br /> Planning Commission.
<br />2.07 "MAP ACT" shall mean the
<br /> Subdivision Map Act of the
<br /> State of California.
<br />2.08 ".M I N O R RESIDENTIAL
<br /> S TR~:ET", OR "rN'~U~T-
<br /> RIA~ ~ER~I~ SI~ET"
<br /> shall mean a street intended
<br /> wholly or principally for lo-
<br /> cal traffic, or service ~o abut-
<br /> ting property.
<br />2.09 "~II NOR SUBDIVISION"
<br /> shall mean a subdivision so
<br /> designated by the Subdivi-
<br /> sion Committee as specified
<br /> in Article 5, Section 5.01.
<br />2A0"SERVICE ALLEY" or
<br />"A L L E Y" shall mean a
<br />street providing only second-
<br />ary access to abutting prop-
<br /> t~y.
<br />2.11 "FRONTAGE ROAD" shall
<br /> mean a street adjacent to a
<br /> thoroughfare, freeway o r
<br /> parkway, separated there-
<br /> from by a dividing strip and
<br /> providing ingress and ag-
<br /> tess from abutting property.
<br />2.12 "STANDAI~D SPECIFICA-
<br /> TIONS" shall mean such
<br /> Standard Subdivision Ira-
<br /> provement Details and Spec-
<br /> ifications as prepared by the
<br />
<br /> · City Engineer, as recom-
<br /> mended for approval by the
<br /> Planning Commission, and
<br />
<br /> as approved by resolution
<br /> of the City Council of the
<br /> City of Plaasanton.
<br /> 2.13 "SUBDIVIDER" shall mean
<br /> any individual, fi,tm, asso-
<br /> ciation, syndicate, co-part-
<br /> nerzhip, corporation, trust
<br /> or any other legal entity
<br /> commencing proceedings un-
<br /> der this Ordinance, to effect
<br /> a subdivision of land here-
<br /> under for himself or for
<br /> another, and while used here
<br /> in masculine gender and sin-
<br /> gular number, it shall be
<br /> deemed to mean and include
<br /> the feminine or neuter gen-
<br /> der and the plural number
<br /> whenever required.
<br /> "~L~IMV~ION" shall mean
<br /> any real property, improved
<br /> or unimproved, or portion
<br /> thereof, shown on the latest
<br /> adopted Alameda County tax
<br /> roR as a unit or contiguous
<br /> units, which is divided, for
<br /> the purpose of sale, lease,
<br /> or separate use, whether
<br /> immediate or future, by any
<br /> subdivider, into twa or more
<br /> lots, plats, sites or other div-
<br /> isions of land for said sale,
<br /> lease or separate use.
<br />2.15 "PUBLIC UTILITY" shall
<br /> mean private corporations
<br /> or governmental jurisdic-
<br /> tions authorized by law to
<br /> establish and maintain any
<br /> such w o r k s or facilities
<br /> in, under or over any public
<br /> street, and any such works
<br /> or facilities themselves. This
<br /> ordinance shall not be con-
<br /> strued to limit the powers
<br /> and duties vested by law in
<br /> the Public Utilities Com-
<br /> mission's of the State of
<br /> California, and in the event
<br /> of any complaint the Public
<br /> Utilities Commissions's or-
<br /> ders, ~-ales and regulations
<br /> shall govern.
<br />2.16 "I~'P~OVI/~,~TS''
<br /> (~JI~C): Improvements
<br /> as used herein shall mean
<br /> those public works improve-
<br /> ments normally constructed
<br /> within street rigbt~ of way
<br /> or public easements, as a
<br /> part of the subdivision im-
<br /> provements, including but
<br /> not limited to curb, gutter,
<br /> sidewalk, street paving, sew-
<br /> ers, water lines, storm drain
<br /> facilities, trees, fi, re hy-
<br /> drant, s, and street lights.
<br /> It shall also include rough
<br /> grading the building sites
<br /> to provide a buildable site
<br /> with proper drainage.
<br />
<br /> ARTICLE 3
<br /> ~UBD1VISION CONF~.NCE
<br /> 3.01 SUBDMSION C O M M I T-
<br /> TEE. The Planning Commis-
<br /> sion shall establish a com-
<br /> mittee which shall include
<br /> one or more members of
<br /> the Planning Commission
<br /> and shall include the City
<br /> Administrator, the City Eh-
<br /> gineer or a designated mem-
<br /> ber o/ their staffs.
<br /> 3.02.SUBMSSION OF PRELIM,
<br /> INARY MAP. Prior to the
<br /> filing of a tentative map,
<br /> the subdivider shall submit
<br /> to the City Clerk twelve
<br /> (12) copies of the plans and
<br /> other information concern-
<br /> ing a proposed or contem-
<br /> p 1 a t e d development. The
<br /> City Clerk will then, within
<br /> fourteen (14) days, ached-
<br /> ule a conference of the Sub-
<br /> division Committee with the
<br /> subdivider on such plans
<br /> and other data and the Com-
<br /> mittae will make such gen-
<br /> eral recommendations to the
<br /> subdivider as shall seem
<br /> proper regarding such plans
<br /> or data, and shall recom-
<br /> mend consultations by the
<br /> subdivider with other public
<br /> or private agencies as may
<br /> be disclosed by the plans
<br /> to be interested.
<br />
<br /> ARTICLE 4
<br /> TENTATIVE MAP
<br />4.01 FILING. The subdivider
<br /> shall file with the Planning
<br /> Commission twenty-five (25)
<br /> white copies and one (1)
<br /> duplicate transparency of
<br /> the tentative map of each
<br /> subdivision and such other
<br /> copies as may be required.
<br /> The time of filing of a ten-
<br /> tative map shall be constru-
<br /> ed to be the time at which
<br /> ,the same, together with the :
<br /> required data, is received in
<br /> the office of the City Clerk, 4.05
<br /> who shall indicate the date
<br /> of filing upon all copies of
<br /> the tentative map and ac-
<br /> companying data.
<br />4.02 FEE. A filing fee of twenty-
<br /> five dollars ($25.00), plus
<br /> onedollar ($I.00) for each
<br /> lot included in the subdi-
<br /> vision, shall be paid at the
<br /> time of filing the tentative
<br /> map. If additional tentative
<br /> maps covering the same
<br /> tract er revisions of the in-
<br /> itial map are filed by the
<br /> same subdivider prior to of-
<br /> ficial action by the Plan-
<br />
<br /> ning Commission, no addi-
<br /> tional fee will be required.
<br />4.03..DISTRIBUTION. W i t h i n
<br /> four (4) days after the fil-
<br /> ing of the tentative map,
<br /> the City Clerk shall trans-
<br /> mit the requested number
<br /> of copies of said map to-
<br /> gether with sccompanlying
<br /> data to such public agencies
<br /> and/or utilities as may be
<br /> affected or concerned with
<br /> the results of the proposed
<br /> subdivision. Each of the pub-
<br /> lic agencies and/or utilities
<br /> may within fourteen (14)
<br /> days after the map has been
<br /> filed, forward to the Com-
<br /> mission written reports of
<br /> its findings and recomme.
<br /> datioas thereof. The City
<br /> Engineer shall prepare a
<br /> written report of recommen-
<br /> dations on the tentative
<br /> map in relation to the re-
<br /> quirements of this Ordin-
<br /> ance and other applicable
<br /> .regulations of the City of
<br /> Pleasanton or other public
<br /> agencies, and shall submit
<br /> the same to the Planning
<br /> Commission within two days
<br /> prior to the scheduled Plan-
<br /> ning Commission meeting at
<br /> which said map is to be con-
<br /> sidered.
<br />4.04 NOTIFICATION. Approval,
<br /> di,s~pproval or conditional
<br /> approval of the tentative
<br /> map shall be made in writ.
<br /> ing to the subdivider. One
<br /> copy of the map and accom-
<br /> panying data and the Plan-
<br /> ning Commission r e p o r t
<br /> thereon shall remain in the
<br /> permanent file of the Plan-
<br /> ning Commission. The City
<br /> Clerk shall send one copy
<br /> of the report of the Com-
<br /> mission, showing the action
<br /> taken, to the subdivider, and
<br /> one copy to ibc City Coun-
<br /> cil.
<br /> PREPARATION. The subdi-
<br /> vider shall cause the tenta-
<br /> tive map of the land propos-
<br /> ed to be subdivided to be
<br /> prepared by a person com-
<br /> petent in ~he preparation of
<br /> such maps, such as a regis-
<br /> tered civil engineer or lic-
<br /> ensed surveyor or practic-
<br /> ing land or city planner.
<br /> Such tentative map shall be
<br /> in full compliance with the
<br /> requirements of this Ordin-
<br /> ance. Topog~raphy and boun-
<br /> daries of said tentative map
<br /> shall be certified as to ac-
<br /> curacy by a registered civil
