ORDINANCE NO. 355 <br />AN ORDINANCE OF THE CITY <br /> OF pLEASANTON, ALAME- <br /> DA COUNTY, CALIFORNIA, <br /> ADOPTING REGULATIONS <br /> FOR THE DEVELOPMENT <br /> <br />· OF LAND AS SUBDIVISIONS, <br /> PROVIDING PROCEDURES, <br /> PENALTIES FOR THE VIO- <br /> LATION THEREOF, AND RE- <br /> PEALING ALL OTHER OR- <br /> DINANCES IN CONFLICT· <br /> The City Council of the City <br />of Pleasanton does ordain as <br />lows: <br /> ARTICLE 1 <br /> GENERAL PROVISIONS <br />1.00 AUTHORITY. This Ordi- <br /> nance is enacted pusuant to <br /> Section 11 of Article XI of <br /> the Contitution of Californ- · <br /> ia, and the general laws of <br /> the State of California, in- <br /> cluding the Subdivision Map <br /> Act, Section 11500 et seq., <br /> Business and Professional <br /> Code. The provisions of this <br /> Ordinance are in addition <br /> to the ~egulations of the <br /> Subdivision Map Act and <br /> are supplemental thereto. <br />t.01 PUItPOSE. The purpose of <br /> tl~s Ordinance is to control <br /> and regulate the division of <br /> any land for: any pui~pose <br /> whatsoever within the' City <br /> of Pleasanton and such land <br /> as may b~ annexed to said <br /> City. It includes re,subdivi- <br /> sion, the process of eubdivid- <br /> lng, or the land or territory <br /> subdivided, including plan- <br /> <br />1.03 SAME: EXISTING CONDI. <br /> TIONS, Consideration shall <br /> be given to provision for <br /> uniformity of street widths <br /> and for proper alignments <br /> and street names. Preserva- <br /> tion of the privacy and safe- <br /> ty of streets in residential <br /> areas shall be encouraged <br /> by control of through ira~fic <br /> in such areas. The amount <br /> of street required shall be <br /> directly related to the traf- <br /> fic generating uses of abutt- <br /> ing land. Intersections on <br /> streets, highways and other <br /> trafficways shall be reduced <br /> to a minimum consistent <br /> with the basic needs of in- <br /> gress and egress. Intersec- <br /> tions shall be so designed <br /> · to provide for the greatest <br /> safety both for pedestrians <br /> and' ~ motorists. Provisions <br /> shall be made for assuring <br /> adequate light, air and pri- <br /> vacy on all parcels of pro- <br /> perty, regardless of the <br /> land use. The topography of <br /> the land shall be respected, <br /> and where cutting and fill- <br /> ing is necessary ..the quality <br /> of the development shall be <br /> maintained. Streets shall be <br /> designed to minimize eXces- <br /> sive grading and scarring of <br /> the landscape. Problems of <br /> drainage shall be resolved <br /> in such manner as to permit <br /> the occuphnts of the sub- <br /> division reasonable security <br /> against floodtng. <br /> <br /> ned unit developments. · <br /> The status of proposed plan- <br /> ned u n i t developments <br /> shall be determined by the <br /> City Planning Commission <br /> in accordance with the pro- <br /> visions of Ordinance No. <br /> 309, the Zoning Ordinance. <br />1.02 CONSIDERATIONS: GEN- <br /> ERAL PLAN AND ZONING <br /> ORDINANCE. The General <br /> Plan shall guide the use of <br /> all ]and within the corpor- <br /> ate boundaries of the City. <br /> Thc type and intensity of <br /> land use as shown on the <br /> General Plan shall deter- <br /> mine the types of streets, <br /> roads, highways and other <br /> utilities and public facilities <br /> that shall be provided by <br /> the subdivider. No land <br /> shall be subdivided and de- <br /> velop.ed for any purpose not <br /> contemplated or specifically <br /> authorized by the precise <br /> Zoning Ordinance of the <br /> City of Pleasanton. <br /> <br />1.04 SAME: COMM~UNITY FA- <br /> CILITIES. Cgmmunity fa- <br /> cilities shall be provided for <br /> in the subdivision process. <br /> This Ordinance establishes <br /> procedures for She referrel <br /> of p r o p o s e d subdivision <br /> maps to pertinent govern- <br /> menta] agencies and utility <br /> companies, both public and <br /> private, so that the exten- <br /> sion of community facilities <br /> and utilities may be accom- <br /> plished in an orderlymanner <br /> concurrent with a subdivi- <br /> sion of land. In o~der to fa- <br /> cilitate the acquisition of <br /> public land area required, <br /> the Planning Commission <br /> may require the subdivider <br /> to reserve land for schools, <br /> p ar ks, playgrounds and <br /> other public purposes. Do- <br /> nation and dedication of <br /> land area consistent ~vith the <br /> standards of the General <br /> Plan and in such locations <br /> as will implement the Gen- <br /> <br /> eral Plan may be accepted <br /> by the City Council. <br />1.05 GENERAL RESPONSIBILI- <br /> TIES: SUBDIVIDER. The <br /> subdivider s h a 11 prepare <br /> maps consistent with the de- <br /> sign standards and accom- <br /> plish improvements consis- <br /> tent with the improvement <br /> standards contained in this <br /> Ordinance and shall process <br /> said maps through the Plan- <br /> ning ,Commission in accord- <br /> anee with the regulations set <br /> forth herein. <br />1.06 SAME: CITY CLERK. The <br /> City Clerk shall stamp the <br /> date and time received and <br /> be responsible for the ex- <br /> peditious processing of such <br /> maps and prompt referral <br /> thereof to the pertinent gov- <br /> ernmental agencies and af- <br /> fected utility companies, <br /> both public and private. <br /> The City Clerk shall co- <br /> ordinate the dissemination <br /> of information regarding <br /> the proposed subdivision of <br /> land. The Planning Com- <br /> mission, .shall consider the <br /> written reports of the pqb- <br /> lie agencies in recommend- <br /> ing approval, conditional ap- <br /> proval, or disapproval of the <br /> proposed subdivision. Dis- <br /> tribution may include but <br /> is not limited to the fol- <br /> lowing: <br /> 1. The C o u nt y Planning <br /> Commission. <br /> 2. The Planning Commis- <br /> sion of any other City with~ <br /> in one (1) rhile of said sub- <br /> division. <br /> 3. The District Engineer <br /> of the Division of Highways <br /> of the State of California. <br /> 4. The affected school dis- <br /> trict or districts. <br /> 5. The City Fire Depart- <br /> ment. <br /> 6. The County Health of- <br /> ricer. <br /> 7. The City Engineer. <br /> g. The County Surveyor. <br /> 9. The Alameda County <br /> Flood Control and Water <br /> Conservation District. <br /> 10. Pleasanton Township <br /> County Water District. <br /> 11. Pacific Gas and Electric <br /> Company. <br /> 12. Pacific Telephone and <br /> Telegraph Company. <br /> 1.07 SAME: CITY ENGINEER. <br /> The City Engineer shall be <br /> responsible for reporting to <br /> the Planning Commission <br /> and the City Council as to <br /> <br /> whether the proposed, im- <br /> provements are consistent <br /> with the regulations contain- <br /> ed herein and shall be re- <br /> sponsible further for the <br /> supervision and ultimate ap- <br /> proval of all such improve- <br /> ments. <br />1.08 SAME: PLANNING COM- <br /> MISSION. The Planning <br /> Commission shall act as the <br /> "advisory agency" to the <br /> City Council and is charged <br /> with the dnty of making in- <br /> vestigations and reports on <br /> the design and improvement <br /> of proposed subdivisions <br /> and the conformance of <br /> such subdivisions wiVh the <br /> General Plan and this Or- <br /> dinance. The Planning Com- <br /> mission shall report its ac- <br /> tions and recommendations <br /> concerning the tentative <br /> map direct to the subdivider. <br />1.09 SAME: CITY COUNCIL. <br /> The City Council of the <br /> Cit~ of Pleasanton, being the <br /> legislative body, has final <br /> jurisdiction over all final <br /> subdivision maps. Reports <br /> to the City Council regard- <br /> ing subdivisions within or <br /> contiguous to the City for <br /> their information and ac- <br /> tion, s.hall be made in writ- <br /> ing as an integral par~ of <br /> the subdivision process. <br /> <br /> ARTICLE 2 <br /> DEFINITIONS <br />2.00 DEFINITION OF WORDS <br /> AND PHRASES. Words or <br /> phrases not defined herein, <br /> but defined in the Business <br /> and Professions Code of Cal- <br /> ifornia, or in the Zoning <br /> Ordinance of the City of <br /> Pleasanton, shall be used <br /> as though defined herein in <br /> full, unless the context clear- <br /> ly indicates a contrary in- <br /> tentiun. <br />2.01 "BLOCK" shall mean an <br /> area of land within a sub- <br /> division which area is en~ <br /> tlrely bounded by streets, <br /> highways, or ways, except <br /> alleys, or the exterior boun- <br /> dary or boundaries of the <br /> subdivision. <br />2.62 "CO~LE~CTOR STREET" <br /> shall mean a sIreet intermed- <br /> fate in importance between <br /> minor residential slreet and <br /> a major or secondary thor- <br /> oughfare which has the put- <br /> pose of collecting local traf- <br /> tic and carrying it to a thor- <br /> oughfare. <br /> 2.03 "CUL-DE-SAC" shall mean <br /> <br /> <br />
