ORDINANCE NO. 355 AN ORDINANCE OF THE CITY OF pLEASANTON, ALAME- DA COUNTY, CALIFORNIA, ADOPTING REGULATIONS FOR THE DEVELOPMENT · OF LAND AS SUBDIVISIONS, PROVIDING PROCEDURES, PENALTIES FOR THE VIO- LATION THEREOF, AND RE- PEALING ALL OTHER OR- DINANCES IN CONFLICT· The City Council of the City of Pleasanton does ordain as lows: ARTICLE 1 GENERAL PROVISIONS 1.00 AUTHORITY. This Ordi- nance is enacted pusuant to Section 11 of Article XI of the Contitution of Californ- · ia, and the general laws of the State of California, in- cluding the Subdivision Map Act, Section 11500 et seq., Business and Professional Code. The provisions of this Ordinance are in addition to the ~egulations of the Subdivision Map Act and are supplemental thereto. t.01 PUItPOSE. The purpose of tl~s Ordinance is to control and regulate the division of any land for: any pui~pose whatsoever within the' City of Pleasanton and such land as may b~ annexed to said City. It includes re,subdivi- sion, the process of eubdivid- lng, or the land or territory subdivided, including plan- 1.03 SAME: EXISTING CONDI. TIONS, Consideration shall be given to provision for uniformity of street widths and for proper alignments and street names. Preserva- tion of the privacy and safe- ty of streets in residential areas shall be encouraged by control of through ira~fic in such areas. The amount of street required shall be directly related to the traf- fic generating uses of abutt- ing land. Intersections on streets, highways and other trafficways shall be reduced to a minimum consistent with the basic needs of in- gress and egress. Intersec- tions shall be so designed · to provide for the greatest safety both for pedestrians and' ~ motorists. Provisions shall be made for assuring adequate light, air and pri- vacy on all parcels of pro- perty, regardless of the land use. The topography of the land shall be respected, and where cutting and fill- ing is necessary ..the quality of the development shall be maintained. Streets shall be designed to minimize eXces- sive grading and scarring of the landscape. Problems of drainage shall be resolved in such manner as to permit the occuphnts of the sub- division reasonable security against floodtng. ned unit developments. · The status of proposed plan- ned u n i t developments shall be determined by the City Planning Commission in accordance with the pro- visions of Ordinance No. 309, the Zoning Ordinance. 1.02 CONSIDERATIONS: GEN- ERAL PLAN AND ZONING ORDINANCE. The General Plan shall guide the use of all ]and within the corpor- ate boundaries of the City. Thc type and intensity of land use as shown on the General Plan shall deter- mine the types of streets, roads, highways and other utilities and public facilities that shall be provided by the subdivider. No land shall be subdivided and de- velop.ed for any purpose not contemplated or specifically authorized by the precise Zoning Ordinance of the City of Pleasanton. 1.04 SAME: COMM~UNITY FA- CILITIES. Cgmmunity fa- cilities shall be provided for in the subdivision process. This Ordinance establishes procedures for She referrel of p r o p o s e d subdivision maps to pertinent govern- menta] agencies and utility companies, both public and private, so that the exten- sion of community facilities and utilities may be accom- plished in an orderlymanner concurrent with a subdivi- sion of land. In o~der to fa- cilitate the acquisition of public land area required, the Planning Commission may require the subdivider to reserve land for schools, p ar ks, playgrounds and other public purposes. The City Clerk shall stamp the date and time received and be responsible for the ex- peditious processing of such maps and prompt referral thereof to the pertinent gov- ernmental agencies and af- fected utility companies, both public and private. The City Clerk shall co- ordinate the dissemination of information regarding the proposed subdivision of land. The Planning Com- mission, .shall consider the written reports of the pqb- lie agencies in recommend- ing approval, conditional ap- proval, or disapproval of the proposed subdivision. Dis- tribution may include but is not limited to the fol- lowing: 1. The C o u nt y Planning Commission. 2. The Planning Commis- sion of any other City with~ in one (1) rhile of said sub- division. 3. The District Engineer of the Division of Highways of the State of California. 4. The affected school dis- trict or districts. 5. The City Fire Depart- ment. 6. The County Health of- ricer. 7. The City Engineer. g. The County Surveyor. 9. The Alameda County Flood Control and Water Conservation District. 10. Pleasanton Township County Water District. 11. Pacific Gas and Electric Company. 12. Pacific Telephone and Telegraph Company. 1.07 SAME: CITY ENGINEER. The City Engineer shall be responsible for reporting to the Planning Commission and the City Council as to whether the proposed, im- provements are consistent with the regulations contain- ed herein and shall be re- sponsible further for the supervision and ultimate ap- proval of all such improve- ments. 1.08 SAME: PLANNING COM- MISSION. The Planning Commission shall act as the "advisory agency" to the City Council and is charged with the dnty of making in- vestigations and reports on the design and improvement of proposed subdivisions and the conformance of such subdivisions wiVh the General Plan and this Or- dinance. The Planning Com- mission shall report its ac- tions and recommendations concerning the tentative map direct to the subdivider. 1.09 SAME: CITY COUNCIL. The City Council of the Cit~ of Pleasanton, being the legislative body, has final jurisdiction over all final subdivision maps. Reports to the City Council regard- ing subdivisions within or contiguous to the City for their information and ac- tion, s.hall be made in writ- ing as an integral par~ of the subdivision process. ARTICLE 2 DEFINITIONS 2.00 DEFINITION OF WORDS AND PHRASES. Words or phrases not defined herein, but defined in the Business and Professions Code of Cal- ifornia, or in the Zoning Ordinance of the City of Pleasanton, shall be used as though defined herein in full, unless the context clear- ly indicates a contrary in- tentiun. 2.01 "BLOCK" shall mean an area of land within a sub- division which area is en~ tlrely bounded by streets, highways, or ways, except alleys, or the exterior boun- dary or boundaries of the subdivision. 2.62 "CO~LE~CTOR STREET" shall mean a sIreet intermed- fate in importance between minor residential slreet and a major or secondary thor- oughfare which has the put- pose of collecting local traf- tic and carrying it to a thor- oughfare. 2.03 "CUL-DE-SAC" shall mean
