P19-0008, 5200 Franklin Drive Planning Commission <br />2 of 11 <br />In January 2019, Mr. Glen Dawson, on behalf of the Art of Problem Solving (AoPS) Academy, <br />requested to operate a tutoring facility at 5200 Franklin Drive, Suite 110. As the existing PUD <br />approvals did not include tutoring facilities either as a permitted or conditionally permitted use, <br />a PUD minor modification (PUD-80-16-17M) was processed for the subject site to: (1) allow <br />tutoring facilities with no more than 20 students in the facility at one time subject to a Minor <br />Conditional Use Permit; and (2) allow tutoring facilities with more than 20 students in the <br />facility at one time subject to a Conditional Use Permit. Notices of the proposed PUD minor <br />modification were sent to property owners and tenants located within 1,000-foot radius of the <br />project site. No comments were received. On February 26, 2019, the Zoning Administrator <br />approved the requested PUD minor modification. A copy of the approval is attached as Exhibit <br />C. <br /> <br />Following the approval of the PUD minor modification, the conditional use permit to operate <br />AoPS, a tutoring facility with a maximum of 72 students on premises at one time, is now before <br />the Planning Commission for consideration. <br /> <br />SITE AND AREA DESCRIPTION <br />The subject site is approximately 2.67 acres in area and is located on the northwest corner of <br />Franklin Drive and Johnson Drive (see Figure 1). The subject building is approximately 33,800 <br />square feet in area and currently has two office-use tenants (Extreme Network in Suite 100 <br />and Teichert in Suite 115). The proposed AoPS would occupy Suite 110, located in the <br />southwest quadrant of the building (See Figure 2). Surrounding uses consist mainly of office <br />uses. <br /> <br />Primary access to the site is provided by two driveways, one from each street. The project site <br />does not share drive aisles or parking with the adjoining parcels.
