Location and Notification Map <br />STAFF RECOMMENDATION <br />Staff recommends the Planning Commission approve Conditional Use Permit (CUP) Case No. <br />P19-0008, based on the findings and subject to the draft conditions of approval in Exhibit A. <br />EXECUTIVE SUMMARY <br />The applicant requests CUP approval to operate a tutoring facility for up to 72 students at <br />certain times at 5200 Franklin Drive, Suite 110. Tutoring facilities with more than 20 students <br />on-site at a time require Planning Commission review and approval of a CUP. As proposed <br />and conditioned, staff finds the use is consistent with the intent of the General Plan and <br />objectives of the zoning district and will be compatible with the surrounding uses, and therefore <br />recommends approval of the CUP. <br />BACKGROUND <br />The project site is located on the northwest corner of Franklin Drive and Johnson Drive in a <br />PUD-I/C-O District. It is a part of a multi-parcel Planned Unit Development (PUD) approved <br />under Case No. PUD-80-16. The approval allowed and conditionally allowed a wide range of <br />uses in the PUD, including offices, warehousing, manufacturing, health clubs and daycare <br />centers. In 2012, a PUD minor modification was approved to allow State registered heritage <br />schools to be operated within the subject PUD area as a conditionally permitted use.
