Resolution No. 04-066 <br />Page Two <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing on September 7, 2004, at which time <br />the appellant, applicants, and any other member of the public were offered <br />an opportunity to present evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />after further review of the materials presented, the City Council has <br />determined that the proposed project, as conditioned, is appropriate for the <br />site and is consistent with the zoning regulations for the zoning district of <br />the property. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. Makes the following findings for the variances: <br /> <br />Because of special circumstances applicable to the property, <br />including size, shape, topography, location or surroundings, the strict <br />application of the provisions of this chapter deprives such property <br />of privileges enjoyed by other properties in the vicinity and under <br />identical zoning classification. <br /> <br />Setback Variances. The RM-4,000 zoning district requires a <br />minimum lot width of 70 feet, a minimum depth of 100 feet, and a <br />minimum lot area of 8,000 square feet. At 50 feet wide, the lot does <br />not meet the minimum lot width requirement. If the property met <br />the minimum lot width of 70 feet or 20 feet wider than it actually is, <br />the variances for the side yard setback and sloping roof plane would <br />not have been necessary. The existing lot is also substandard in lot <br />size. It is 5,000 square feet in lot area were the minimum required <br />lot size area for the RM-4,000 district is 8,000 square feet. If the <br />existing lot met the minimum required lot size, assuming that both <br />the lot width and lot depth were increased, the required rear yard <br />setback could have been met. The narrower lot width and smaller lot <br />size have ~nade the subject lot difficult for the owners to follow the <br />restrictions of the zoning regulations. In addition, the City has in <br />recent years approved other variances for detached structures. The <br />approved detached accessory structures were a mix of one- and <br />two-story buildings with substandard lot dimensions and/or lot area. <br />Therefore, this finding for the side and rear yard setback variances <br />can be made. <br /> <br /> <br />
