CITY C, OUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-066 <br /> <br />RESOLUTION APPROVING THE APPLICATION OF JEAN LUC AND <br />MAUREEN CHATELAIN FOR VARIANCES AND DESIGN REVIEW <br />APPROVALS, AS FILED UNDER CASE PAP-69/PV-98/PADR-932 <br /> <br />WHEREAS, Jean Luc and Maureen Chatelain have applied for variances from the <br /> Municipal Code and for administrative design review approval to legalize <br /> an existing two-story accessory structure located at 4432 First Street with a <br /> second unit on the second floor (1) to allow the building to be located <br /> approximately two feet, six inches from the side (northerly) property line <br /> and approximately one foot, nine inches from the rear (easterly) property <br /> line where a minimum five-foot side yard setback and a minimum ten-foot <br /> rear yard setback, respectively, are required for a detached second unit; <br /> (2) to allow the building to be approximately 25 feet in height where a <br /> maximum building height of 15 feet is allowed for a detached accessory <br /> structure; and (3) to allow the northern sloping plane to be approximately <br /> three feet from the side (northerly) property line where a minimum often <br /> feet is required; and <br /> <br />WHEREAS, zoning for the property is RM-4,000 (Multiple-Family Residential) District; <br /> and <br /> <br />WHEREAS, <br /> <br />at its meeting of July 28, 2004, the Planning Commission, after having <br />considered all public testimony, relevant exhibits, and recommendations of <br />City staff concerning this application, approved the application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the decision of <br /> the Planning Commission was appealed to the City Council; and <br /> <br />WHEREAS, <br /> <br />at its meeting of September 7, 2004, the City Council received a report <br />from the Director of Planning and Community Development, together with <br />a copy of the staffreport to the Planning Commission, regarding this <br />matter; and <br /> <br /> <br />
