SECTION VII (Continued) <br /> 5. Abstinence <br /> During a voice or electronic vote, to abstain is considered a vote with the majority <br /> unless the Councilmember has declared a conflict of interest. <br /> F. Tie Votes <br /> 1. If there are no vacancies on the Council, and if all Councilmembers are not present, <br /> a tie vote on a motion shall be carried forward to the next meeting at which all <br /> Councilmembers are present. <br /> 2. If all Councilmembers are present, but one or more Councilmembers abstain, or if <br /> there is a vacancy on the City Council: <br /> a. As to any matter which the City Council is required by law to take final <br /> action, a tie vote on a motion shall be considered no action. <br /> b. As to any matter which the City Council is considering on appeal, a tie vote <br /> on a motion shall be deemed no action and the decision which was appealed <br /> shall stand. <br /> 3. Any person whose application is not approved or is denied as a result of this <br /> policy may reapply in accordance with the Pleasanton Municipal Code. <br /> .••. Nothing contained in this policy shall prohibit a Councilmember who could <br /> not participate in the original decision due to a conflict of interest from <br /> participating in a decision involving a resubmitted application if the <br /> Councilmember is no longer required to abstain. <br /> G. Continuation of an Item <br /> 1. Continuance by a Councilmember. <br /> Any Councilmember may continue an item not subject to a legally Y ( � g ly or City-unposed <br /> deadline) to the next Council meeting or to another date agreeable to a majority of <br /> the Council. An agenda item may be continued only once using this procedure. <br /> 2. Other Continuances <br /> The applicant or other member of the public P p may request a continuance of an item <br /> and a Council majority may grant one continuance, provided, however that a request <br /> for a further continuance may be granted by a 4/5 vote of the Council and only if it <br /> finds that: <br /> a. the need for the continuance was beyond the control of the person requesting <br /> it; and <br /> .•. <br /> 16 <br /> f <br />
