ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DECLARING A STAGE 2 WATER SHORTAGE, MANDATING PLEASANTON WATER <br /> CUSTOMERS REDUCE POTABLE WATER USAGE BY FIFTEEN PERCENT (15%), <br /> ACTIVATING STAGE 2 WATER SHORTAGE RATES, AND APPLYING EXCESS USE <br /> PENALTIES AS NEEDED <br /> WHEREAS, perfluorohexanesulfonic acid (PFHxS) is a member of a large class of <br /> chemicals known as per- and polyfluoroalkyl substances (PFAS) and new health-based <br /> notification and response levels have been established; and <br /> WHEREAS, in response, Council directed staff to take all three of the City's wells out of <br /> service and consequently the City no longer has access to its annual 3,500 Acre Foot (AF) <br /> groundwater supply and is relying 100 percent on Zone 7 Water Agency (Zone 7) water supplies; <br /> and <br /> WHEREAS, the City must get replacement water from Zone 7 through connections <br /> (turnouts) to the Zone 7's regional distribution system; and <br /> WHEREAS, testing on the turnouts showed that turnouts can produce enough flow to <br /> meet demands experienced during the mandatory fifteen percent water conservation; and <br /> WHEREAS, continued conservation is still necessary to reduce summer peak demand <br /> because of distribution concerns related to the City's groundwater wells not being in operation; <br /> and <br /> WHEREAS, Drought/Water Shortage Rates are intended to help keep the City's water <br /> utility financially sustainable during a drought or water shortage emergency by offsetting the <br /> revenue impacts of decreased consumption (e.g., due to mandatory conservation) while also <br /> providing an additional incentive to conserve water and discourage wasteful or inefficient water <br /> use through pricing, and <br /> WHEREAS, if the water conservation target is not met after imposing the Stage 2 Water <br /> Drought Rates, then staff would recommend that the City Council consider implementing the <br /> Excess Use Penalties to further discourage wasteful or inefficient water use. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the Stage 2 Water Drought/Water Shortage Rates have no <br /> possibility to have a significant effect on the environment per Title 14 California Code of <br /> Regulations §15061(b)(3). <br /> SECTION 2. Declares a Stage 2 water shortage pursuant to Municipal Code Chapter <br /> 9.30 and City's Water Shortage Contingency Plan <br /> SECTION 3. Mandates that Pleasanton water customers reduce potable water usage by <br /> fifteen percent (15%) as compared to 2020. <br /> 1 <br />
