•Guidelines: . . . Guidelines are provided to convey informational guidance to applicants and convey the <br /> subjective design intent and desires of the Pleasanton community for new development, but are not legally <br /> enforceable, nor shall they be permitted under current California law to be grounds for rejecting <br /> development applications. <br /> And you'll see in Section B9: Compatibility with Surrounding Development, many of the protections/requirements <br /> provided for are listed as'Design Guidelines' making them legally unenforceable, specifically: <br /> • B9.a -Consider providing setbacks that match adjacent single family properties. <br /> • B9.b- Enhanced landscaping should be provided along shared property lines including a variety of trees and <br /> shrubs, including plantings of sufficient height to filter and screen views between properties. <br /> • B9.c- Include an increased setback for floors above the adjacent lower height residential developments to <br /> reduce visual perception of height. <br /> In fact,the only objective 'standard' refers to locating the tallest structures furthest from property lines abutting existing <br /> single-family land uses.Additionally,the latest ODS draft increases the maximum height for projects with density ranges <br /> greater than 14 up to 29 du/ac, from approx. 30ft to approx. 36ft. <br /> REVIEW PROCESS <br /> Per Part 1: Introduction, Section E: Project Review and Approval Procedures-all development applications for identified <br /> housing sites will be reviewed by the Zoning Administrator(for projects up to 50 units) or by Planning Commission (for <br /> projects greater than 50 units); who shall consider and render a decision regarding whether the project complies with <br /> applicable objective design standards and related environmental mitigation measures. <br /> Taken together,this means the developer could place buildings up to 36ft tall directly on the property line, so long as <br /> there are no taller buildings in the development; as the only objective design standard is the 36ft height limitation. <br /> I am particularly concerned with the Tri-Valley Inn site location, as my and my neighbors' properties back directly into <br /> the Tri-Valley Inn site and we are single-story single-family houses. I don't believe the ODS as currently drafted protects <br /> us, our privacy, the enjoyment of our property, and our property value from a development directly on that shared <br /> property line.
