5. The development plan shall be of no further validity and the project developer shall be <br /> required to submit the same or new development plan for City approval prior to <br /> development of the site in the event that the project developer fails to record a final <br /> map within two (2) years of PUD approval. <br /> <br />6. Prior to recordation of the final parcel map, all required fees applicable to this <br /> property contained in the North Sycamore Specific Plan Finance Plan shall be paid. <br /> As determined by the City, the applicants' payment may be adjusted pursuant to any <br /> agreement for roadway dedication done as a part of comprehensive NSSP <br /> infrastructure improvements. <br /> <br />7. The project developer shall fund school facilities necessary to off-set this project's <br /> reasonably related impacts on the long-term needs for expanded school facilities to <br /> serve new development in Pleasanton. Determination of the method and manner of <br /> the provision of the funds and/or facilities shall be made by the Pleasanton Unified <br /> School District and the City, and it may be in addition to the: school impact fees <br /> required by State law and local ordinance. The program shall be a successor to the <br /> documents entitled "Cooperation Agreement" and "Flat Fee Agreement", and shall <br /> specifically include the project's obligation to fund its share of all future schools, <br /> including whatever high school option is selected by the Pleasanton Unified School <br /> District. The project developer shall be required to participate in the above- <br /> referenced program or in any successor program, prior to issuance of any building <br /> permit for the project. <br /> <br />8. Unless otherwise required, the building developer shall pay the in-lieu park dedication <br /> fees in effect at the time building permits are issued for the structures to be <br /> constructed on the lots created with the final parcel map. <br /> <br />9. Unless otherwise approved by the Planning Director, the three lots shall become part <br /> of the North Sycamore Specific Plan Maintenance Association, and the owner shall <br /> pay their pro-rata share of maintenance cost for the shared i~nprovements. <br /> <br />10. The applicant shall apply for a demolition permit from the Building Department to <br /> remove the existing barn. Unless otherwise approved by the Planning Director, ail of <br /> the demolition must be completed prior to recordation of the final parcel map or sale <br /> of Lot 2. <br /> <br />11. The developer acknowledges that the City of Pleasanton does not guarantee the <br /> availability of sufficient sewer capacity to serve this development by the approval of <br /> this case, and that the developer agrees and acknowledges that building permit <br /> approval may be withheld it! sewer capacity is found by the City not to be available. <br /> <br />2 <br /> <br /> <br />
