Contractor shall develop a specific route review methodology for the Container inspections, 2633 <br />and such methodology shall comply with the minimum requirements of this Section and 14 2634 <br />CCR Section 18984.5(b). Contractor shall submit its proposed route review plan for the coming 2635 <br />year to the City no later than January 15 of each year, which shall describe, at a minimum, 2636 <br />Contractor’s proposed methodology and schedule for performance of each route’s annual 2637 <br />review in accordance with the City’s standards. If requested by the City, Contractor’s 2638 <br />proposed route review methodology shall include its plan for prioritizing the inspection of 2639 <br />Customers that are more likely to be out of compliance, as identified by the Contractor, City, 2640 <br />the City’s designee, and/or CalRecycle. Contractor’s methodology shall include its proposed 2641 <br />process for identifying Prohibited Container Contaminants. The City, and/or its designee, such 2642 <br />as StopWaste or CalRecycle, will review and approve the proposed methodology. Contractor 2643 <br />may commence with the proposed methodology upon approval. Alternatively, the City 2644 <br />reserves the right to develop the contamination minimization methodology, and Contractor 2645 <br />shall use the City-developed methodology, provided that such methodology can be 2646 <br />reasonably performed within two hundred (200) working hours. If the City’s proposed 2647 <br />methodology directs the Contractor to expend greater than two hundred (200) working hours 2648 <br />to conduct the Route reviews, Contractor shall be entitled to compensation, in accordance 2649 <br />with subsection A.5 below. 2650 <br />4. The City Contract Manager may request, and Contractor shall accept, modifications to the 2651 <br />schedule to permit observation of the Route reviews by the City or its designee. In addition, 2652 <br />Contractor shall provide an email notice to the City’s Contract Manager no less than ten (10) 2653 <br />business days prior to each scheduled Route review that includes the specific time(s), which 2654 <br />shall be within the City’s normal business hours, and location(s) for the review. 2655 <br />5. If the City determines that the Contractor’s methodology is inadequate, City shall notify the 2656 <br />Contractor and provide an estimate of the number of additional hours required to correct the 2657 <br />inadequacy. Contractor shall revise the methodology accordingly; and, after obtaining City 2658 <br />approval, conduct additional Route reviews, increase Container inspections, or implement 2659 <br />other changes using the revised procedure. Contractor shall be entitled to compensation for 2660 <br />the additional hours spent beyond the budgeted two hundred (200) hours, as estimated by 2661 <br />the City, using the same hourly rate and adjustment methodology specified in subsection A.1 2662 <br />above. 2663 <br />B. Contamination Response and Notification. Upon identification of Prohibited Container 2664 <br />Contaminants in a Customer’s Container during the annual route review, Contractor shall Collect 2665 <br />the material as a courtesy to the Customer and provide the Customer with a notice of 2666 <br />contamination (“Courtesy Pick-Up Notice”) at the Customers door or gate; or, subject to City’s 2667 <br />approval, may deliver the notice by mail, e-mail, or text message. Contractor shall also attach or 2668 <br />adhere a Courtesy Pick-Up Notice to Generators’ contaminated Containers. 2669 <br /> The Courtesy Pick-Up Notice shall, at a minimum: 2670 <br />1. Inform the Customer of the observed presence of Prohibited Container Contaminants; 2671 <br />2. Include the date and time the Prohibited Container Contaminants were observed; 2672 <br />3. Include information on the Customer’s requirement to properly separate materials 2673
