The City shall review the materials submitted and work responsively with 1634 <br />Contractor to understand the scope of the concerns identified. Upon verification of the information 1635 <br />provided by the Contractor, the City shall direct a change to the Contractor to deliver Organic 1636 <br />Materials to a new Approved Organic Materials Processing Site and/or may add an additional 1637 <br />Approved Organic Materials Processing Site. 1638 <br /> As outlined in Section 8.4.A of the Agreement, as the result of a City-directed change in the 1639 <br />Approved Organic Materials Processing Site, a Special Rate Review will be conducted. The Special 1640 <br />Rate Review will be conducted expeditiously as outlined below. 1641 <br />1. The City will notify the Contractor within five (5) days of written notification by Contractor, 1642 <br />directing the change and/or addition of an Approved Organic Materials Processing Site. 1643 <br />2. The Contractor will provide to the City within fourteen (14) days of City notice directing a change 1644 <br />to (or addition of) the Approved Organic Materials Processing Site the following information: 1645 <br />a. Draft agreement with Organic Material Processing Site that outlines the term of the 1646 <br />agreement and cost of the service. 1647 <br />b. Facility name, Owner, operator, address, contact person, and telephone number. 1648 <br />c. Estimated Tonnage to be taken to the new Organic Materials Processing Site daily. 1649 <br />d. A descriptive narrative of any proposed change to the Organic Materials Collection 1650 <br />process. Outline how Organic Materials will be Collected, pre-Processed, stored, and 1651 <br />Transferred to the new Organic Materials Processing Site. Provide information that 1652 <br />outlines any change in Transfer Station function and/or operation. 1653 <br />e. Provide Transportation cost for Tonnage brought to the new Organic Materials 1654 <br />Processing Site. 1655 <br />3. The Contractor will provide additional information as requested by the City in order to make 1656 <br />the special Rate adjustment. The City’s review of the draft agreement between Contractor and 1657 <br />the proposed facility shall not be subject to any confidentiality agreement. The duty to defend 1658 <br />any proprietary information shall be the obligation of the Contractor in the event the City 1659 <br />receives a Public Records Act request. 1660 <br />4. Within thirty (30) days, the City will prepare the special Rate adjustment based upon the 1661 <br />information provided by Contractor and will present to the City Council for recommended 1662 <br />approval. 1663 <br />5. Upon City Council approval of the special Rate adjustment, the City Contract Manager will 1664 <br />provide Contractor written approval for use of the new or additional Approved Organic 1665 <br />Materials Processing Site. 1666 <br />6. The City and Contractor will publish the new Rates on their respective websites. 1667 <br />7. The Contractor will send a letter notifying Customers of the special Rate adjustment, including 1668 <br />when new Rates will take effect. 1669 <br />Below is information about the Approved Organic Materials Processing Site selected by the 1670 <br />Contractor: 1671
