Periodically, the Contractor shall review 1685 <br />Tonnage records and marketing records to determine the City’s Residue level and the average 1686 <br />percentage of products marketed from the Compost Product (e.g., Compost, Mulch, soil 1687 <br />amendment, etc.). The percentages determined from the review of Tonnage and marketing records 1688 <br />shall be used to allocate the total Tonnage Collected in the City into various categories of Organic 1689 <br />Materials and Residue. 1690 <br />If Contractor is unable to use the Approved Organic Materials Processing Site due to an emergency 1691 <br />or sudden unforeseen closure of the Approved Organic Materials Processing Site, Contractor may 1692 <br />use an alternative Processing Site provided that the Contractor provides verbal and written notice 1693 <br />to the City and receives written approval from the City at least twenty-four (24) hours prior to the 1694 <br />use of said alternative Processing Site. The Contractor’s written notice shall include a description 1695 <br />of the reasons the Approved Organic Materials Processing Site is not feasible and the period of time 1696 <br />Contractor proposes to use the alternative Organic Materials Processing Site. 1697 <br />Contractor shall not be compensated for any increased Transportation and Processing costs 1698 <br />associated with the use of Organic Materials Processing Site(s) different from the Approved Organic 1699 <br />Materials Processing Site. 1700 <br />Contractor shall observe and comply with all regulations in effect at the Approved Organic Materials 1701 <br />Processing Site and cooperate with and take direction from the operator thereof with respect to 1702 <br />delivery of Organic Materials. Contractor shall actively work with the Approved Organic Materials 1703 <br />Processing Site operator throughout the Term of this Agreement to ensure that contamination of 1704 <br />the Organic Materials Collected under this Agreement and delivered to the Processing Site remains 1705 <br />below the limits established by Applicable Law including, without limitation, SB 1383. 1706 <br />If City requests that Compostable Plastics be included as an Organic Material Collected under this 1707 <br />Agreement, Contractor shall make commercially reasonable efforts to locate an Approved Organic 1708 <br />Materials Processing Facility that will accept Compostable Plastics, subject to City approval. 1709 <br />Contractor shall notify the City in writing at least six (6) months prior to the commencement of the 1710 <br />program, and annually thereafter, of the acceptable materials requirements of the Approved 1711
