Contractor shall provide reports on Recyclables Processing as required by Section 6.3 1593 <br />and 6.4. 1594 <br />5.13.3 Organic Materials Processing 1595 <br />A. General. Contractor shall Transport all Organic Materials Collected in the City to the Approved 1596 <br />Organic Materials Processing Site. Contractor shall pay all costs associated with Transfer (if 1597 <br />applicable), Transporting, Processing, Composting, and marketing of Organic Materials. All Organic 1598 <br />Materials shall be Processed for use as Compost, Mulch, or soil amendment and none shall be 1599 <br />Disposed or used as Alternative Daily Cover or Alternative Intermediate Cover. Residue from the 1600 <br />Organic Materials Processing activities shall be Disposed of by Contractor or the Organic Materials 1601 <br />Processing Site Subcontractor at a Disposal Site selected by the Contractor or the Organic Materials 1602 <br />Processing Site Subcontractor. 1603 <br /> Any and all Transfer, Processing, Composting, and other Discarded Materials handling activities 1604 <br />performed in the City shall occur in an enclosed facility and areas used for parking, vehicle access, 1605 <br />and operations shall be paved. 1606 <br />B. Processing Arrangements. Contractor shall secure sufficient capacity with sufficient term to 1607 <br />Process and Compost Organic Materials Collected under this Agreement and Contractor will cause 1608 <br />the Approved Organic Materials Processing Site to Process, Compost, and market Organic Materials. 1609 <br />Promptly upon direction from City, Contractor shall provide City with documentation satisfactory 1610 <br />to City demonstrating availability of Organic Materials Processing and Composting capacity at the 1611 <br />Approved Organic Materials Processing Site and any Approved Transfer Station Site used to deliver 1612 <br />materials to such site. 1613 <br /> Contractor shall keep all existing permits and approvals necessary for use of the Approved Organic 1614 <br />Materials Processing Site in full regulatory compliance or confirm that the Owner or operator of 1615 <br />such facility does so. Contractor shall, upon request, provide copies of permits and/or notices of 1616 <br />violation of permits to the City. 1617 <br /> Contractor may change its selection of the Approved Organic Materials Processing Site following 1618 <br />City’s written approval, but the Contractor’s Compensation and Rates will not be adjusted, and 1619 <br />Contractor will bear any increased Transportation and Processing costs associated with a 1620 <br />Contractor-initiated change in the Approved Organic Materials Processing Site. In such case, 1621 <br />Contractor shall guarantee the same net Organic Materials Processing Cost specified in Exhibit F or 1622 <br />shall reduce the net Organic Materials Processing Costs associated with the use of an Organic 1623 <br />Materials Processing Site(s) different from the Approved Organic Materials Processing Site. If 1624 <br />Contractor elects to use an Organic Materials Processing Site(s) that is different than the Approved 1625 <br />Organic Materials Processing Site, it shall request written approval from the City Manager or their 1626 <br />designee sixty (60) calendar days prior to use of the site and obtain the City’s written approval no 1627 <br />later than ten (10) calendar days prior to use of the site. 1628 <br /> The City shall direct a change to a new Approved Organic Materials Processing Site in the event that 1629 <br />the Approved Organic Materials Processing Site is no longer able to Process some or all of the City’s 1630 <br />Organic Materials due to State or local permit requirements that change the acceptability of Organic 1631 <br />Material type(s). The Contractor shall notify the City in writing immediately and provide 1632 <br />documentation identifying concerns (e.g., letter from Approved Processing Site, Permit citing the 1633
