Collection Services <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 44 June 7, 2022 <br />evidence, reasonably satisfactory to the City, that such terms are not commercially available, the 1513 <br />City Contract Manager shall waive this obligation. 1514 <br />Contractor shall keep all existing permits and approvals necessary for use of the Recyclable 1515 <br />Materials Processing Site(s) in full regulatory compliance or confirm that the Owner or operator of 1516 <br />such facility does so. Contractor shall, upon request, provide copies of permits and/or notices of 1517 <br />violation of permits to the City. 1518 <br />Contractor may change its selection of the Approved Recyclable Materials Processing Site following 1519 <br />City’s written approval, but Contractor shall not be compensated for any increased Transportation 1520 <br />and Processing costs. Contractor will bear any increased Transportation and Processing costs 1521 <br />associated with a Contractor-initiated change in the Approved Recyclable Materials Processing Site. 1522 <br />In such case, Contractor shall guarantee the same net Processing Cost specified in Exhibit F or shall 1523 <br />increase the net Processing Costs (if the amount is a net revenue) associated with the use of 1524 <br />Processing Site(s) different from the Approved Recyclable Materials Processing Site. If Contractor 1525 <br />elects to use a Recyclable Processing Site(s) that is different than the Approved Recyclable Materials 1526 <br />Processing Site, it shall request written approval from the City sixty (60) calendar days prior to use 1527 <br />of the site and obtain the City’s written approval no later than ten (10) calendar days prior to use of 1528 <br />the site. 1529 <br />Below is information about the Approved Recyclable Materials Processing Site selected by the 1530 <br />Contractor: 1531 <br />• Facility Name: City Automatic Recycling, Inc. 1532 <br />• Owner: Robert Molinaro and Anthony Macchiano 1533 <br />• Operator: City Automatic Recycling, Inc. 1534 <br />• Address: 3110 Busch Road in Pleasanton, CA 1535 <br />• Contact Person and telephone number: Robert Molinaro (925) 846-2042 1536 <br />• Current term and opportunities for extension of agreement: N/A 1537 <br />• Method of allocating Recyclable Materials Diverted by material type and Processing Residue 1538 <br />to the City (from among two or more jurisdictions): allocation by inbound weight for 1539 <br />Recyclable Materials and for Processing Residue. 1540 <br /> 1541 <br />Contractor shall Collect Recyclable Materials generated in the City in Collection vehicles separately 1542 <br />from other Recyclable Materials generated outside the City and shall weigh each vehicle so that the 1543 <br />Tonnage of Recyclable Materials can be documented on a per-load basis with supporting 1544 <br />documentation (such as a certified weight ticket or tag). Periodically, the Contractor shall review 1545 <br />its marketing records to calculate the volume of Recyclable Materials received at the Approved 1546 <br />Recyclable Materials Processing Site and marketed to determine the percentage of various 1547 <br />Recyclable Materials (e.g., glass, newspaper, cardboard, PET, HDPE, aluminum, etc.) and the City’s 1548 <br />Residue level. The percentages determined from the review of marketing records shall be used to 1549 <br />allocate the total Tonnage Collected in the City into various categories of Recyclable Materials and 1550 <br />Residue. 1551
