Collection Services <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 43 June 7, 2022 <br />Contractor shall Collect Solid Waste generated in the City in Collection vehicles separately from 1473 <br />other Solid Waste generated outside the City and shall weigh each vehicle so that the Tonnage of 1474 <br />Solid Waste can be documented on a per-load basis with supporting documentation (such as a 1475 <br />certified weight ticket or tag). 1476 <br />If Contractor is unable to use the Approved Disposal Site due to an emergency or sudden unforeseen 1477 <br />closure of the Approved Disposal Site, Contractor may use an alternative Disposal Site provided that 1478 <br />the Contractor provides verbal and written notice to the City and receives written approval from 1479 <br />the City at least twenty-four (24) hours prior to the use of an alternative Disposal Site. The 1480 <br />Contractor’s written notice shall include a description of the reasons the Approved Disposal Site is 1481 <br />not feasible and the period of time Contractor proposes to use the alternative Disposal Site. 1482 <br />Contractor shall not be compensated for any increased Transportation and Disposal costs associated 1483 <br />with the emergency use of Disposal Site(s) different from the Approved Disposal Site. 1484 <br />C. Transport. The Contractor is responsible for Transporting Collected Solid Waste to the Approved 1485 <br />Disposal Site by large-capacity Transfer vehicle haul. If the Contractor plans to change its Transport 1486 <br />method, Contractor shall obtain written approval from the City prior to making the change; pay all 1487 <br />costs; and shall not be reimbursed for any additional costs. The City shall approve the Transport 1488 <br />method, and the duration the Transport method is expected to remain in use. 1489 <br />D. Reporting. Contractor shall provide reports on Solid Waste Disposal and Recyclables Processing as 1490 <br />required by Sections 6.3 and 6.4. 1491 <br />5.13.2 Recyclables Processing 1492 <br />A. General. Contractor agrees to Transport and deliver all Source Separated Recyclable Materials it 1493 <br />Collects in the City to the Approved Recyclable Materials Processing Site. Contractor shall pay all 1494 <br />costs associated with Transfer (if applicable), Transporting, Processing, and marketing of Recyclable 1495 <br />Materials. Residue remaining after Recyclable Materials Processing shall be Disposed of by 1496 <br />Contractor or the Processing Site Subcontractor at a Disposal Site selected by Contractor or the 1497 <br />Processing Site Subcontractor. Any and all Transfer, Processing, and other Discarded Materials 1498 <br />handling activities performed in the City shall occur only at a facility that is in compliance with all 1499 <br />City permit requirements and all other Applicable Law that applies to operations at such facility. A 1500 <br />site in the City used by Contractor for Discarded Materials handling activities of any kind will be 1501 <br />subject to the City’s strict development permit review process. 1502 <br />B. Processing Arrangements. Contractor shall secure sufficient capacity to Process Recyclable 1503 <br />Materials Collected under this Agreement and shall cause the Approved Recyclable Materials 1504 <br />Processing Site to Process and market the Recyclable Materials. Contractor shall provide the City, 1505 <br />upon request, with documentation demonstrating the availability of such capacity. 1506 <br />If Contractor provides these services, it shall make a good faith effort to achieve a Residue level no 1507 <br />greater than twenty-five percent (25%), where the Residue level shall be calculated as 100 1508 <br />multiplied by the monthly Tonnage of Processing Residue requiring Disposal divided by the total 1509 <br />monthly Tonnage of Recyclable Materials Collected. If the Contractor does not provide these 1510 <br />services, it shall contractually require of the third party processor that it achieve this Residue level. 1511 <br />If Contractor cannot obtain such contract provision, so notifies City Contract Manager, and provides 1512
