Definitions <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 14 June 7, 2022 <br />1.96 "Residential Premises" means a site occupied by a building zoned for Residential occupation 453 <br />where Solid Waste, Recyclable Materials, or Organic Materials are generated or accumulated. No 454 <br />place used primarily for business purposes shall be considered a Residential unit. 455 <br />1.97 “Residue or Residual (or any variation thereof)” means those materials which, after Processing, 456 <br />are Disposed rather than Recycled or Composted due to either the lack of markets for materials or 457 <br />the inability of the Processing Site to capture and recover the materials. 458 <br />1.98 "Reuse Vendor" means a vendor (e.g., St. Vincent DePaul, Goodwill Industries, or other non-profit 459 <br />or for-profit organizations) that will collect used furniture and other re-usable items for purposes of 460 <br />reuse rather than Disposal. 461 <br />1.99 “SB 1383” means the Short-Lived Climate Pollutants Act of 2016 (an act to add Sections 39730.5, 462 <br />39730.6, 39730.7, and 39730.8 to the Health and Safety Code, and to add Chapter 13.1 [commencing 463 <br />with Section 42652] to Part 3 of Division 30 of the Public Resources Code, relating to methane 464 <br />emissions), also commonly referred to as "SB 1383," as amended, supplemented, superseded, and 465 <br />replaced from time to time. For the purposes of this Agreement, SB 1383 specifically refers to the 466 <br />Short-Lived Climate Pollutants (SLCP): Organic Waste Reductions regulations developed by CalRecycle 467 <br />and adopted on November 3, 2020 that created Chapter 12 of 14 CCR, Division 7 and amended 468 <br />portions of regulations of 14 CCR and 27 CCR. 469 <br />1.100 "Salvageable Material" means those Discarded Materials that may be reused in their existing form 470 <br />or may be reused after some form of Processing including, but not limited to, Organic Materials and 471 <br />Recyclable Materials. 472 <br />1.101 “Self-Hauler” or “Self-Haul” means a Person who hauls Solid Waste, Organic Materials, Recyclable 473 <br />Materials, or other Discarded Materials they have generated to another Person for disposition, as 474 <br />permitted by the City and otherwise in accordance with all Applicable Law. Self-Hauler also includes 475 <br />a Person who back-hauls such materials, and as otherwise defined in 14 CCR Section 18982(a)(66). 476 <br />1.102 “Service Level” means and refers to the number and size of a Customer’s Container(s) and the 477 <br />frequency of Collection service. 478 <br />1.103 "Service Type" means and refers separately to the following types of Solid Waste, Recyclable 479 <br />Materials, and Organic Materials Collection services for each of the following types of services: Single-480 <br />Family, Multi-Family Cart Service, Multi-Family, Commercial Cart Service, Commercial Bin Service, 481 <br />Drop Box Service, and City facilities service. 482 <br />1.104 "Single-Family" means any detached or attached house or residence designed or used for 483 <br />occupancy by one (1) family, provided that Collection service feasibly can be provided to such 484 <br />Premises as an independent unit, and the Owner or Occupant of such independent unit is billed 485 <br />directly for the Collection service. Single-Family includes Residential units of a duplex, triplex, or 486 <br />fourplex Residential structure provided that each unit is separately billed for their specific Service 487 <br />Level. 488
