Definitions <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 15 June 7, 2022 <br />1.105 "Small Commercial Generator" means any Commercial Generator which generates less than 489 <br />ninety-six (96) gallons of Solid Waste per week and which subscribes to Cart Service. 490 <br />1.106 "Solid Waste" means all Putrescible and Non-putrescible solid, semisolid, and associated liquid 491 <br />waste, including garbage, trash, refuse, paper, rubbish, ashes, industrial wastes, discarded home and 492 <br />industrial Appliances, dewatered, treated or chemically fixed sewage sludge which is not a Hazardous 493 <br />Waste, special waste, manure, vegetable or animal solid and semi-solid wastes, and other discarded 494 <br />solid and semi-solid wastes, which the City Municipal Code requires Generators within the City to set 495 <br />out for Collection. Solid Waste does not include the following: 496 <br />A. Salvageable Materials set out for Collection in a Container, which is specifically designated 497 <br />for Recyclable Materials or Organic Materials; 498 <br />B. Hazardous Waste; 499 <br />C. Radioactive waste; 500 <br />D. Infectious Waste provided that Infectious Waste, whether treated or untreated, is not 501 <br />Disposed of at a Solid Waste facility; and, 502 <br />E. Abandoned automobiles. 503 <br />Solid Waste includes Salvageable Materials only when such materials are included for Collection in 504 <br />a Solid Waste Container. 505 <br />1.107 "Source Separated" means the segregation from Solid Waste, by the Generator, of materials 506 <br />designated for separate Collection for some form of materials recovery or special handling. 507 <br />1.108 “State” means the State of California. 508 <br />1.109 “Subcontractor” means a party who has entered into a contract, express or implied, with the 509 <br />Contractor for the performance of an act that is necessary for the Contractor’s fulfillment of its 510 <br />obligations under this Agreement and approved by the City in accordance with Section 12.6 of this 511 <br />Agreement for services such as, but not limited to, Collection, Transportation, Processing, Diversion, 512 <br />sales or marketing of Recyclable Materials or Organic Materials, staffing, public education, Customer 513 <br />service, and billing, or other service whose cost is a substantial portion of the Contractor’s total annual 514 <br />cost. Notwithstanding any other provision in this Agreement, vendors providing materials, supplies, 515 <br />or professional services to Contractor, and Approved Facilities that are not Affiliates of Contractor, 516 <br />shall not be considered Subcontractors for any purpose under this Agreement. 517 <br />1.110 “Tier One Commercial Edible Food Generator” means a Commercial Edible Food Generator that 518 <br />is one of the following, each as defined in 14 CCR Section 18982: 519 <br />A. Supermarket. 520 <br />B. Grocery Store with a total facility size equal to or greater than 10,000 square feet. 521
