Definitions Franchise Agreement with Pleasanton Garbage Service City of Pleasanton Page 7 June 7, 2022 under this Agreement, or otherwise alleging a violation by Contractor of the provisions of this 213 Agreement; or, (ii) alleging that an entity is out of compliance with SB 1383. 214 1.37 "Compost (or Composting)" means a method of treatment in which organic wastes are biologically 215 decomposed under controlled, aerobic, or anaerobic conditions to produce a safe and nuisance-free 216 Compost Product. 217 1.38 “Compostable Plastics” or “Compostable Plastic” means plastic materials that meet the ASTM 218 D6400 standard for compostability. 219 1.39 “Compost Product” means the product resulting from the controlled biological decomposition of 220 Organic Materials that are Source Separated from the municipal Solid Waste stream, or which are 221 separated at a centralized facility. 222 1.40 "Construction and Demolition Debris (or C&D)" means used or discarded construction materials 223 removed from Premises during the construction or renovation of a structure resulting from 224 construction, remodeling, repair, or demolition operations on any pavement, house, Residential 225 property, Commercial building, or other structure. 226 1.41 "Container" means a receptacle for temporary storage of Solid Waste, Organic Materials, or 227 Recyclable Materials to be Collected by Contractor. Container includes a Cart, Bin, Drop Box, or 228 Compactors. 229 1.42 "Contractor" means Pleasanton Garbage Service, Inc. or PGS, a corporation organized and 230 operating under the laws of the State of California and its officers, directors, employees, agents, 231 companies, and Subcontractors. 232 1.43 "Contractor’s Compensation" means the monetary compensation received by Contactor from 233 Customers in return for services provided by Contractor in accordance with this Agreement as 234 described in, and pursuant to Article 8. 235 1.44 "Contractor’s Proposal" means the proposal submitted by Contractor on June 23, 2017 for 236 provision of Solid Waste, Recyclable Materials, and Organic Materials services in the City as modified 237 by this Agreement and Exhibit F, which is incorporated by reference. 238 1.45 "Curb or Curbside" means the location for placement of a Cart for pick-up by Single-Family 239 Customers, which shall be on the street against the face of the Curb, or where no street Curb exists, 240 the Container shall be placed not more than five (5) feet from the outside edge of the street nearest 241 the property’s entrance. In the case of condominiums and townhomes receiving Single-Family service, 242 placement of Carts shall be adjacent to each Residential unit at a location agreed upon by both 243 Contractor and Customer. 244 1.46 “Customer” means the Person to whom Contactor submits billing invoices and from whom 245 Contractor collects payment for Collection services provided to a Premises.
