Definitions <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 6 June 7, 2022 <br />1.28 “City Contract Manager” means the City Manager or their designee. 177 <br />1.29 “Clean Wood” means wood that is not painted, stained, coated, pressure treated, or chemically 178 <br />treated. Clean Wood may include, but is not limited to, dimensional lumber, pallets, crates, chop 179 <br />sticks, tooth picks, stir sticks, and wooden utensils. Clean Wood excludes creosote, lumber treated 180 <br />with chromated copper arsenate (CCA), melamine coated furniture, and manufactured wood 181 <br />products such as plywood, particle board, oriented strand board, and medium density fiberboard. The 182 <br />Parties agree that materials may be added to or subtracted from this list from time to time, in 183 <br />accordance with Applicable Law. Contractor shall not add or subtract materials to or from this list 184 <br />without written approval from the City Contract Manager, and such approval shall not be 185 <br />unreasonably withheld. Clean Wood is a subset of Organic Materials. 186 <br />1.30 “Collection” (or any variation thereof) means the removal and Transportation of Solid Waste from 187 <br />the place where it was generated to a Disposal Site and/or the removal and Transportation of 188 <br />Recyclable Materials, Organic Materials, and other Salvageable Materials from the place where such 189 <br />materials were generated to a Processing Site. 190 <br />1.31 "Commencement Date" means the date specified in Section 3.1 when Collection, Transportation, 191 <br />Processing, and Disposal services required by this Agreement shall be provided. 192 <br />1.32 "Commercial" means of, from or pertaining to non-Residential Premises where business activity is 193 <br />conducted, including, but not limited to, wholesale and retail sales and operations, services, 194 <br />manufacturing, and industrial operations, but excluding businesses conducted upon Residential 195 <br />property which are permitted under applicable zoning regulations and are not the primary use of the 196 <br />property. 197 <br />1.33 “Commercial Edible Food Generator” includes Tier One Commercial Edible Food Generators and 198 <br />Tier Two Commercial Edible Food Generators, or as otherwise defined in 14 CCR Section 18982(a)(7). 199 <br />For the purposes of this definition, Food Recovery Organizations and Food Recovery Services are not 200 <br />Commercial Edible Food Generators, or as otherwise specified by 14 CCR Section 18982(a)(7). 201 <br />1.34 “Community Composting” means any activity that Composts green material, agricultural material, 202 <br />food material, and vegetative food material, alone or in combination, and the total amount of 203 <br />feedstock and Compost on-site at any one time does not exceed one hundred (100) cubic yards and 204 <br />seven hundred fifty (750) square feet, as specified in 14 CCR Section 17855(a)(4); or as otherwise 205 <br />defined in 14 CCR Section 18982(a)(8). 206 <br />1.35 "Compactor" means a mechanical apparatus that compresses materials. Compactors include two 207 <br />(2) to four (4) cubic yard Bin compactors serviced by front-end loader Collection trucks and six (6) to 208 <br />fifty (50) cubic yard Drop Boxes serviced by roll-off Collection trucks. 209 <br />1.36 "Complaint" means written or orally communicated statements made by members of the public, 210 <br />Owners or Occupants of properties served by Contractor, or officers, employees or agents of City 211 <br />alleging: i) non-performance or deficiencies in performance of Contractor’s duties and obligations 212
