Definitions <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 8 June 7, 2022 <br />Occupant or Owner of the Premises provided that the Owner of the Premises shall be responsible for 247 <br />payment of Collection services if an Occupant of a Premises, which is identified as the Customer of 248 <br />Owner’s Premises, fails to make such payment. 249 <br />1.47 "Delivery" means placement of Solid Waste, Recyclable Materials, or Organic Materials by a 250 <br />Generator in a receptacle or at a location that is designated for Collection pursuant to the City's 251 <br />Municipal Code. 252 <br />1.48 "Designated Waste" means non-Hazardous Waste which may pose special Disposal problems 253 <br />because of its potential to contaminate the environment and which may be Disposed of only in Class 254 <br />II Disposal Sites or Class III Disposal Sites pursuant to a variance issued by the California Department 255 <br />of Health Services. Designated Waste consists of those substances classified as Designated Waste by 256 <br />the State of California, in California Water Code 13173. 257 <br />1.49 "Discarded Material" means Solid Waste, Recyclable Materials, Organic Materials, Bulky Items, or 258 <br />Construction and Demolition Debris placed by a Generator in a Container, receptacle or at a location 259 <br />that is designated for Collection pursuant to the City's Municipal Code. 260 <br />1.50 "Disposal or Dispose (or any variation thereof)" means the final disposition of Solid Waste 261 <br />Collected by the Contractor at a Disposal Site approved by the City. 262 <br />1.51 "Disposal Site(s)" means a facility for the ultimate Disposal of Solid Waste. 263 <br />1.52 “Diversion” or “Divert” means activities that reduce or eliminate the amount of Solid Waste from 264 <br />Solid Waste Disposal including, but not limited to, Recycling and Composting. 265 <br />1.53 “Diversion Rate” means the percentage equal to the Tonnage Diverted by Contractor divided by 266 <br />the Tonnage Collected by Contractor multiplied by 100, which reflects the accomplishments of the 267 <br />Contractor’s Diversion programs. 268 <br />1.54 "Drop Box," means a wheeled or sledded Container or Compactor, generally with a capacity of six 269 <br />(6) to fifty (50) cubic yards, suitable for storage of Solid Waste, Recyclable Materials, Organic 270 <br />Materials, or Construction and Demolition Debris that is separately serviced by a truck, which 271 <br />Transports the Drop Box and the materials contained within to a Disposal Site, Processing Site, 272 <br />Transfer Station Site, or Organic Materials Processing Site. 273 <br />1.55 "Drop Box Service" means the service requested by any Generator requiring Drop Boxes for 274 <br />regularly scheduled, ongoing Collection of Solid Waste, Recyclable Materials, or Organic Materials. 275 <br />Drop Box Service does not include temporary Drop Box Collection services typically resulting from 276 <br />construction, demolition, or large clean-out projects. 277 <br />1.56 “Edible Food” means food intended for human consumption. For the purposes of this Agreement, 278 <br />Edible Food is not Solid Waste if it is recovered and not discarded. Nothing in this Agreement requires 279 <br />or authorizes the recovery of Edible Food that does not meet the food safety requirements of the 280
