Indemnity, Insurance, Bond Franchise Agreement with Pleasanton Garbage Service City of Pleasanton Page 111 June 7, 2022 Any failure to comply with reporting provisions of the policies shall not affect coverage provided 3999 to the City, its officials, employees, or volunteers. 4000 Coverage shall state that the Contractor's insurance shall apply separately to each insured 4001 against whom a claim is made or suit is brought, except with respect to the limits of the insurer's 4002 liability. 4003 B. Workers' Compensation and Employers Liability Coverage. The insurer shall agree to waive all 4004 rights of subrogation against the City, its officers, employees, and volunteers for losses arising from 4005 work performed by the Contractor for the City. 4006 C. All Coverages. Each insurance policy required by this clause shall be endorsed to state that coverage 4007 shall not be suspended, voided, canceled by either Party, reduced in coverage or in limits except 4008 after thirty (30) calendar days prior written notice by certified mail, return receipt requested, has 4009 been given to the City. 4010 9.5.5 Acceptability of Insurers 4011 The insurance policies required by this Section shall be issued by an insurance company or companies 4012 authorized to do business in the State of California and with a rating in the most recent edition of Best's 4013 Insurance Reports of size category VII or larger and a rating classification of A or better. 4014 9.5.6 Verification of Coverage 4015 Contractor shall furnish Contractor’s insurance agent a copy of these specifications, and direct the agent 4016 to provide the City with certificates of insurance and with original endorsements affecting coverage 4017 required by this clause. Issuance of documentation indicates the Contractor’s insurance complies with 4018 these provisions. The certificates and endorsements for each insurance policy are to be signed by a Person 4019 authorized by that insurer to bind coverage on its behalf. The certificates and endorsements are to be 4020 received and approved by the City before work commences. The City reserves the right to require 4021 complete, certified copies of all required insurance policies, at any time. 4022 9.5.7 Required Endorsements 4023 A. The Workers' Compensation policy shall contain an endorsement in substantially the following 4024 form: 4025 “Thirty (30) calendar days’ prior written notice shall be given to the City of Pleasanton 4026 in the event of cancellation, reduction in coverage, or non-renewal of this policy.
