The Commercial General Liability Business and Automobile Liability policies shall contain 4034 <br />endorsements in substantially the following form: 4035 <br />1. “Thirty (30) calendar days’ prior written notice shall be given to the City of Pleasanton in the 4036 <br />event of cancellation, reduction in coverage, or non-renewal of this policy. Such notice shall be 4037 <br />sent to: 4038 <br /> City Manager 4039 <br /> City of Pleasanton 4040 <br /> 123 Main Street 4041 <br /> Pleasanton, CA 94566 4042 <br /> 4043 <br />2. "The City of Pleasanton, its officers, employees, and agents are additional insureds on this 4044 <br />policy." The City requires form CG2010 1185. 4045 <br />3. "This policy shall be considered primary insurance as respects any other valid and collectible 4046 <br />insurance maintained by the City of Pleasanton, including any self-insured retention or program 4047 <br />of self-insurance, and any other such insurance shall be considered excess insurance only." 4048 <br />4. "Inclusion of the City of Pleasanton as an insured shall not affect the City's rights as respects any 4049 <br />claim, demand, suit or judgment brought or recovered against the Contractor. This policy shall 4050 <br />protect Contractor and the City in the same manner as though a separate policy had been issued 4051 <br />to each, but this shall not operate to increase the Contractor's liability as set forth in the policy 4052 <br />beyond the amount shown or to which the Contractor would have been liable if only one Party 4053 <br />had been named as an insured." 4054 <br />9.5.8 Delivery of Proof of Coverage 4055 <br />Simultaneously with the execution of this Agreement, Contractor shall furnish the City certificates of each 4056 <br />policy of insurance required hereunder, in form and substance satisfactory to City. Such certificates shall 4057 <br />show the type and amount of coverage, effective dates, and dates of expiration of policies and shall have 4058 <br />all required endorsements. If the City requests, copies of each policy, together with all endorsements, 4059 <br />shall also be promptly delivered to City. 4060 <br />Renewal certificates will be furnished periodically to City to demonstrate maintenance of the required 4061 <br />coverages throughout the Term. 4062 <br />9.5.9 Other Insurance Requirements 4063 <br />A. In the event any services are delegated to a Subcontractor, the Contractor shall require such 4064 <br />Subcontractor to provide statutory workers' compensation insurance and employer's liability 4065 <br />insurance for all of the Subcontractor's employees engaged in the work in accordance with Sections 4066 <br />9.5.2.C and 9.5.4.B. The liability insurance required by Section 9.5.2.A shall cover all Subcontractors 4067 <br />or the Subcontractor must furnish evidence of insurance provided that meets all of the 4068 <br />requirements of this Section 9.5. 4069 <br />B. The Contractor shall comply with all requirements of the insurers issuing policies. The carrying of 4070 <br />insurance shall not relieve Contractor from any obligation under this Agreement.
