Memorandum of Understanding <br />between UC Regents/UC Cooperative Extension Alameda County <br />and Citil of Pleasanton (continued) <br />Decisions regarding the development of the demonstration garden shall have the <br />input of City of Pleasanton staff, including representatives from the Planning <br />Division, along with designated representatives from the UCCE MGP. <br />With respect to fundraising activities conducted for the benefit of the program, <br />the UCCE MGP shall fundraise independent of the City, cover the entire costs of <br />its own fundraising activities, and retain all revenues generated by its own <br />fundraising activities. <br />Expenses related to the garden development and management are the sole <br />responsibility of the UCCE Master Gardener Program. <br />It is understood that all improvements and/or installations made to the site by <br />the UCCE MGP shall be owned solely by the University. Should this MOU be <br />terminated in accordance with the below Item No. VII.h, the University will <br />remove all such improvements and/or installations from the site, unless <br />otherwise agreed by both parties. <br />a. RESPONSIBILITIES OF THE UCCE MASTER GARDENER PROGRAM <br />1. Provide tools, materials, and staffing needed to develop and operate the <br />garden, except as identified in Section II.B. <br />2. Deliver and provide staff and materials for trainings and demonstrations in the <br />establishment and care of the UCCE Master Gardener Program Educational <br />Garden. <br />3. Maintain the garden in a clean and sanitary condition. <br />4. Provide and maintain the irrigation lines and equipment from the point of <br />connection provided by the City, as necessary throughout the program areas. <br />5. Fund the cost of water and electricity used at the site by their program, via a <br />(monthly/quarterly) payment to the City. Upon the UCCE MGP's <br />development of the site, the (monthly/quarterly) payment due shall be <br />established in coordination with the City, based on current rates and <br />anticipated use. The City may annually increase the (monthly/quarterly) rate <br />using the same percentage as the increase in cost for potable water in <br />Pleasanton for the prior year. Alternatively, the City, at the time of <br />construction of utilities to the site, may determine to install a flow meter <br />device serving the MGP site. In this case, the City and UCCE shall mutually <br />determine the appropriate payment by UCCE to the City for actual water use <br />cost from that point. <br />6. Install and maintain the necessary fencing as required by their programs, <br />including an electrified barrier to prevent access by squirrels and other small <br />animals. <br />7. The MGP will be responsible for green waste management and removal, for <br />green waste generated by their use. <br />Page 2 of 9 <br />
