"Contractor shall instruct all Customers and Generators as to any necessary <br /> preparation of materials (e.g., Source Separation requirements and materials that <br /> are Prohibited Container Contaminants), and the proper placement of Containers <br /> for Collection. Contractor shall notify Customers who fail to follow these <br /> instructions by attaching a two (2) inch by six (6) inch tag to the Container with a <br /> description of how Customer has violated such instructions. In the event of non- <br /> Collection as a result of such violation, Contractor shall clearly indicate on the tag <br /> the reason for non-Collection and what steps must be taken by Customer to <br /> recommence service. In cases of extreme or repeated failure to comply with the <br /> instructions, Contractor shall notify the City of the Customer's repeated failures. <br /> Contractor shall maintain a record of non-Collection notices and the reason for <br /> non-Collection, in accordance with Sections 6.2 and 6.3. Additionally, the <br /> Contractor shall conduct the contamination monitoring and noticing procedures <br /> specified in Section 5.22 and Section 5.24. <br /> Section 5.15.8 Renewable Natural Gas (RNG) was added as follows: <br /> --Under this Agreement, the Contractor shall make a reasonable business effort, <br /> subject to Contractor's existing fuel arrangements, for all Collection vehicles to <br /> be powered by RNG generated by a local facility or powered by RNG that is <br /> purchased through a wheeling agreement with a party(ies), provided that the <br /> wheeling agreement is for purchase of gas derived from Organic Waste that has <br /> been diverted from a landfill and Processed at an in-vessel digestion facility that <br /> is permitted or otherwise authorized by Title 14 of CCR to recover Organic Waste <br /> and meets the requirements of 14 CCR Section 18993.1(h). Upon City request, <br /> Contractor shall obtain and provide the City with a written certification by an <br /> authorized representative of the publicly owned treatment works or the wheeling <br /> agreement contractor certifying that the in-vessel digestion facility produces the <br /> RNG consistent with the requirements of 14 CCR Section 18993.1(h). Contractor <br /> shall maintain records of the amount of RNG purchased, if any, and shall report <br /> this information in accordance with Section 6.3. Contractor shall agree to give the <br /> City the right to report this RNG usage toward the City's fulfilment of its annual <br /> recovered Organic Waste product procurement target in accordance with 14 <br /> CCR Section 18993.1." <br /> Section 5.16.5 New Container Standards was amended to add SB 1383 requirements <br /> as follows: <br /> "Contractor shall differentiate Solid Waste Containers, Recyclable Materials <br /> Containers, and Organic Materials Containers from each other by providing <br /> Containers of different colors, with high-quality educational labels. Containers <br /> shall have bodies and lids in uniform colors that differentiate the different material <br /> types to be Collected, in accordance with Section 5.16.7, and such plans shall be <br /> approved by the City. On and after January 1, 2022, all new or replacement <br /> Containers shall comply with the color and labeling requirements of Section <br /> Page 11 of 22 <br />
