c. Estimated Tonnage to be taken to the new Organic Materials Processing <br /> Site daily. <br /> d. A descriptive narrative of any proposed change to Organic Materials <br /> Collection process. Outline how Organic Materials will be Collected, pre- <br /> Processed, stored, and Transferred to the new Organic Materials <br /> Processing Site. Provide information that outlines any change in Transfer <br /> Station function and/or operation. <br /> e. Provide Transportation cost for Tonnage brought to the new Organic <br /> Materials Processing Site. <br /> 3. The Contractor will provide additional information as requested by the City in <br /> order to make the special Rate adjustment. The City's review of the draft <br /> agreement between Contractor and the proposed facility shall not be subject to <br /> any confidentiality agreement. The duty to defend any proprietary information <br /> shall be the obligation of the Contractor in the event the City receives a Public <br /> Records Act request. <br /> 4. Within thirty (30) days, the City will prepare the special Rate adjustment based <br /> upon the information provided by Contractor and will present to the City Council <br /> for recommended approval. <br /> 5. Upon City Council approval of the special Rate adjustment, the City Contract <br /> Manager will provide Contractor written approval for use of the new or <br /> additional Approved Organic Materials Processing Site. <br /> 6. The City and Contractor will publish the new Rates on their respective <br /> websites. <br /> 7. The Contractor will send a letter notifying Customers of the special Rate <br /> adjustment, including when new Rates will take effect." <br /> Section 5.13.3 F Compost Product Use by City was amended as follows: <br /> "The City will notify Contractor as to the City's needs for delivery of finished <br /> Compost Product throughout the calendar year. Contractor shall deliver Compost <br /> Product within ten (10) Business Days, upon City request to any accessible <br /> location within City limits at no additional cost to the City. If the City does not <br /> exercise its right to request the one thousand (1,000) cubic yards of Compost <br /> Product in a given calendar year, the remaining amount that was not requested <br /> may not be carried over to subsequent calendar years." <br /> Section 5.14.8 Improper Set-Out and Non-Collection Notices was amended to include <br /> instructions to the Contractor regarding new recording keeping requirements to comply <br /> with SB 1383. <br /> Page 10 of 22 <br />
