A Direct Service Provider is a person, company, agency, district, or other entity <br /> that provides a service or services to the City pursuant to a contract or other <br /> written agreement. Departments responsible for services that require or would <br /> benefit from the use of compost and/or mulch, including but not limited to the <br /> Operations Services Department, must: <br /> 5.4.2.1 Use and require Direct Service Providers to use Compost and SB <br /> 1383 Eligible Mulch as practicable, whenever available that meets quality <br /> standards. Departments are encouraged to utilize Compost and SB 1383 <br /> Eligible Mulch that the Office of the City Manager centrally procures. <br /> 5.4.2.2 Keep, and require Direct Service Providers to keep, records of <br /> Compost and SB 1383 Eligible Mulch purchases, and submit these <br /> records as attachments to invoices submitted to the Finance <br /> Department for payment. Records shall include: <br /> (i) General description of how and where the product was used and <br /> applied, if applicable; <br /> (ii) Source of product, including name,physical location, and contact <br /> information for each entity, operation, or facility from whom the <br /> Recovered Organic Waste Products were procured; <br /> (iii) Type of product; <br /> (iv) Quantity of each product; and, <br /> (v) Invoice or other record demonstrating purchase. <br /> 5.4.3. Recovered Organic Waste Product Enforceable Mechanism. <br /> When Procurement of Recovered Organic Waste Products such as Compost, <br /> Mulch, Renewable Gas, or Electricity from Biomass Conversion occurs <br /> through a Direct Service Provider, the responsible department shall enter into <br /> a written contract or agreement or execute a purchase order with enforceable <br /> provisions that includes: <br /> (i) language directing the Direct Service Provider to comply with <br /> the applicable requirements of Appendix A; <br /> (ii)Appendix A as an attachment to the contract or agreement; and <br /> (iii) an enforcement mechanism (e.g., termination, liquidated <br /> damages) in the event the Direct Service Provider is not compliant <br /> with the requirements. <br /> Appendix B includes sample language to meet the requirements of this <br /> Section 5.4.3. <br /> Purchasing Procedures and Manual 19 <br />
