Inspection and Maintenance Agreement. (Address this condition prior to
improvement plan approval)
78. STATE OF CALIFORNIA CONSTRUCTION GENERAL PERMIT: A "Notice of
Intent" (NOI) and "Stormwater Pollution Prevention Plan" (SWPPP) shall be
prepared for construction projects disturbing 1 acre or more of land (including
smaller sites that are part of a larger common plan of development). The
applicant shall include the Waste Discharger Identification Number (WDID) on
the title sheet of the improvement plans and provide proof of coverage under
the State of California Construction General Permit to the Engineering
Department prior to the approval of the improvement plans by the Director of
Engineering/City Engineer. (Address this condition prior to improvement plan
approval)
Subdivisions
79. VACATION OF PUBLIC RIGHT-OF-WAY: The legal description contained within
the Preliminary Report by First American Title Company dated 11-26-2014
(Order Number 0131-620659a1a) references Lots 8, 12, 13, 14, and 15 of the
Rancho Del Valle de San Jose subdivision map (17 M 70) recorded on 11-09-
1896. This map illustrates a public right-of-way separating Lots 12 and 13 from
Lots 14 and 15, although current aerial photographs indicate that no road
currently exists. Said public right-of-way was accepted by the Alameda County
Board of Supervisors on 9-28-1926 according to the deed filed for record in Book
1685 at Page 397. Prior to approval of a final map for Tract 8616, the applicant
shall request the City of Pleasanton (as successors to Alameda County upon
annexation of the area) vacate the public right-of-way in accordance with
California Streets and Highways Code §8300 et seq. and pay all applicable
processing fees. (Address this condition prior to final map approval) (PROJECT
SPECIFIC CONDITION)
80. RIGHT-OF-WAY/EASEMENT DEDICATIONS AND RELINQUISHMENT: The
applicant shall dedicate right-of-way, easements, or relinquish rights to the City on
the final map for Tract 8616 as follows (Address this condition prior to final map
approval):
a. A public access easement (PAE) shall be dedicated across the various
pedestrian/bicycle trails that extend through and around the developed
areas of the subdivision, as well as across the upland trail on Parcel C.
b. The storm drain easement (SDE) across Parcel A shall be limited to a 20'-
width across only the storm drain pipes that drain the public streets. No
SDE is needed across the bioretention area because it will be governed by
a separate Stormwater Treatment Measures Inspection and Maintenance
Agreement between the City and owner/HOA.
PUD-138 and VTM 8616 Planning Commission
