BACKGROUND <br /> On November 20, 1991, the Planning Commission approved a Conditional Use Permit <br /> (UP-91-77, Exhibit C) granting the applicant, Sunshine Saloon, an expansion of an existing bar <br /> at the subject location. This approval included a condition of approval (No. 6) explicitly <br /> prohibiting the consumption of alcohol outside of the bar. This condition was part of staff's <br /> recommendation to the Planning Commission, although the reasoning is unclear, as there was <br /> no detailed discussion of this issue in the meeting minutes (Exhibit D) and staff was unable to <br /> locate the agenda report for the item. However, pursuant to the Planning Commission <br /> discussion in the meeting minutes, the existing bar was noted generally as a good neighbor <br /> with no history of negative impacts on the surrounding areas. <br /> This discussion ultimately led the Commission to question staff about the need for a separate <br /> Condition of Approval, No. 3, which required the applicant to maintain the site in a clean and <br /> orderly manner and to patrol outside areas regularly to maintain peace and quiet. Staff <br /> explained Condition of Approval No. 3 was a standard condition for bar uses; thus, it remained <br /> as part of the Planning Commission action to approve the CUP. Unfortunately, that level of <br /> background detail was not discussed for Condition of Approval No. 6. <br /> More recently, staff inquired with the Police Department regarding any incidents for the existing <br /> bar, especially since June 19, 2020, to the present, when the existing bar received/operated <br /> temporary outdoor dining, including outdoor alcohol service, approval for this location. The <br /> Police Department reported no significant incidents or calls for service in general related to the <br /> existing bar or during the specified period when outside service was being provided, including <br /> no complaints related to violations of the City's Noise Ordinance. Although principally a bar, it <br /> is noted that Sunshine Saloon also offers a full menu including breakfast, lunch and dinner <br /> options. <br /> SITE AND AREA DESCRIPTION <br /> Valley Plaza Shopping Center, constructed generally in the late 1970's and early 1980's <br /> comprises multiple, multi-tenant buildings, as well as two to three standalone drive-through <br /> uses, located along the north side of Valley Avenue and the west side of Santa Rita Road. <br /> Figure 1 on the following page shows Valley Plaza shopping center, the location of Sunshine <br /> Saloon and the surrounding area. <br /> The existing bar is located at the northwest corner of a single-story, multi-tenant, building <br /> which sits on an approximately 2.13-acre parcel within the shopping center, which is generally <br /> rectangular in shape and flat topographically. The overall building area is approximately 22,320 <br /> square feet with the existing bar occupying approximately one-sixth of the total building area, <br /> approximately 3,700 square feet. Access to the shopping center is provided by three driveways <br /> on Valley Avenue and three driveways on Santa Rita Road, with two of the driveways on Santa <br /> Rita Road located directly adjacent to the subject multi-tenant building. There are <br /> approximately 600 shared on-site parking spaces in the shopping center. <br /> The other uses within the shopping center contain various commercial, restaurant, office and <br /> tutoring uses including Jack in the Box, KFC, Limitless Axes and Ales, True Value Hardware, <br /> the UPS Store, The Press Café and the Amador Valley Veterinary Center. Tri-Valley Inn and <br /> Suites is located to the north of the shopping center, Amador Shopping Center is located to the <br /> south of the shopping center across Valley Avenue, and residential uses (both single-family <br /> P21-1206, 1807 Santa Rita Road, Suite K Planning Commission <br /> 2 of 6 <br />
